Cuba's constitution, which was adopted in 1901, included what is called the Platt Amendment, legislation that established Conditions for American intervention in Cuba and gave the United States the right to maintain a military base on the island in perpetuity. The lease contains several critical provisions relevant to whelher U.S. courts have jurisdiction over the base. ‘+ First, the lease gives the United States “complete jurisdiction and contro!” ofthat lerritory, saying merely that it “recognizes the continuance of the ullimate sovereignty of the Republic of Cuba.” ‘+ Secondly, the lease can only be terminated on the mutual consent of both parties. Even though Cuba has wanted to terminate the lease since the revolution in 1959, iis unable to do so without the consent of the United States, The lease actualy provides for a minuscule rent, some two thousand dollars in gold (equivalent to about $4,085 a year in ‘current U.S. dollars), although the Cuban government has refused to accept any payment since 1959. The United Slates is technically in default, and has been for many years, because the laase provides that the base is to be used only for a coaling station. It is time for that status, to be reviewed to determine whether it isan accurate implementation of our laws. 1 write to ask you (o direct your National Security Staff to conduct a review of this designation, Cube does continue to be a totalitarian state that denies its citizens the right to change their government, places severe limitations on freedom of speech and press, constrains the right of peaceful asseinbly and association, restricts freedom of movement, and engages in a number of human rights abuses. But that is obviously different than the criteria used by the State Department to designate a country as a slate sponsor of terrorism or else many other countries ‘would be on the list~ not just Syria, Sudan, Iran, and Cuba, ‘Wo recently passed the 3" anniversary of Alan Gross’ ificarceration in Cuba. While his ‘ongoing detention isa huge source of tension between our two countries, and more normal relations would seem to be difficult, ifnot impossible, while he fs incarcerated, that is a separate issue ffom the dppropriateness ofa terrorist state designation. Conducting a review of our thirty year éld desighation with respect to Cuba's alleged ongoing support of international terrorism can and should go forward.
