Litigation is synonymous with business these days. When engaged in business or any other commercial activity for that matter, disputes do happen and they do have to be taken to courts for their resolve. Some individuals/firms enter into litigation straightaway while others opt for serving a notice upon the opposite party before filing a civil suit in court of competent jurisdiction. There are certain legislations which make it mandatory to issue a legal notice before instituting any litigation otherwise that litigation becomes bad in law, for e.g. The Negotiable Instruments Act, 1938. It therefore becomes necessary to understand the nature and importance of a legal notice in under various laws, in force in India.
