UNITED STATES' RESPONSE TO PLAINTIFFS' OBJECTION TO MAGISTRATE


JUDGE HOMER'S ORDER OF JULY 11,2008

I On September 29,2008, the United States Court of Appeals for the Second Circuit
issued a mandate directing the district court to "construe Appellants' application for an
interlocutory appeal as an objection to the magistrate judge's first order and address such an
objection." (Docket Entry No. 29.) Thus, the United States responds herewith to the arguments
raised in plaintiffs' Application for Leave to Bring an Interlocutory Appeal of the Court's July
11,2008 Order as instructed by the Court on November 26,2008.
