AGREEMENTFORRESIDENTIALHOUSERENOVATION ThisAGREEMENTfortheResidentialHouseRenovation("AGREEMENT")madeand effectivethis______________________,byandbetweenMrs.CARMELAMAY SANTISTEBAN("OWNER")and____________________("CONTRACTOR"). CONTRACTORdesirestoprovideresidentialhouserenovationservicestoOWNER,and OWNERdesirestoutilizetheservicesofCONTRACTORfortheresidentialhouse renovation. NOW,THEREFORE,inconsiderationofthemutualpromiseshereincontained,the partiesheretoagreeasfollows: 1.HouseRenovationServices. CONTRACTORagreestorenderhouserenovationservicestoOWNER,andOWNER agreestoreceiveservicesaccordingtothelistofservices(AppendixA:PROJECT SPECIFICATION).TheresidentialhouseislocatedatNo.3LosRemediosStreet,Bauan, Batangas. 2.Price.

OWNERshallmakepaymentofthepriceinthefollowingdeliveryofservicesby CONTRACTORasprovidedherein,subjecttoOWNERsrightofinspectionassetforthin Section9below. 2.1 PhasesofWork 2.1.1 PHASE1:ConcreteFoundation,PostsandRoof 2.1.2 PHASE2:Walls,wallfoundation,mortar,plaster 2.1.3 PHASE3:Concreteflooringandtiles 2.1.4 PHASE4:Ceiling,gutter/downspout(optional) 2.1.5 PHASE5:Painting 2.2 TermsofPayment,applicableforeachphaseofwork 2.2.1 Downpaymentoneweekbeforethecommencementofphaseof work:40% 2.2.2 Middleofphaseofwork:40% 2.2.3 Endofphaseofwork:20% PricesofbillingamountsshallnotexceedthepricesstatedontheAGREEMENTwithout thewrittenconsentofOWNER.ThepricesstatedcovertheProjectSpecification (AppendixA:PROJECTSPECIFICATION).CONTRACTORshallacknowledgetheinvoiceof paymentasprovidedbyOWNER.OWNERisthesoleresponsibleforthepurchaseand deliveryofmaterials,exceptinoccasionthattheContractorvolunteersforeconomic considerations.AllmaterialsattendantattheOWNERsfacilityareatOWNERsrisk.

Exceptforadditionalrequirementnotstatedherewith,OWNERwillnotberesponsible foranychargenotshowninthespecificationswithoutOWNERspriorwrittenconsent tosuchchargesinadvance. 3.Time. TheperiodofthisResidentialHouseRenovationisfrom_____________to _______________.TimeisoftheessenceofthisResidentialHouseRenovation.If completionisdelayedbeyondthetimeindicatedhereinduetoCONTRACTORs insolvency,OWNERreservestherightwithoutliability(inadditiontoitsotherrightsand remedies)tocancelthisAGREEMENTbywrittennotice,orverbalnoticeconfirmedin writing(whichnoticeshallbeeffectivewhenreceivedbyorcommunicatedto CONTRACTOR)andtochargeCONTRACTORfortherepairworksnotdoneagainstthe advancepayment. 4.RenderingtheHouseRenovationServices CONTRACTORshallrendertheHouseRenovationServicesaccordingtotheproject specification.Theriskoflossfromanycasualty,regardlessofcause,shallbeuponthe CONTRACTORuntilthecompletionoftherenovation.However,CONTRACTORshallnot beliableforanyspecial,indirect,incidentalorconsequentialdamagesarisingoutofor connectedwiththisAGREEMENT. 5.Fabrication OWNERshallnotberesponsibleforanyofCONTRACTORscommitmentsforfabrication inadvanceofthetimenecessarytomeetdeliverydateshereinunlessagreedtoby OWNERinwritinginadvance. 6.SurplusMaterials Allmaterialsinexcessofthosepurchasedconstitutingcustomaryquantityvariations shallbereceived,heldandkeptforpossessionbyOWNER.Thedebrisshallbereceived, heldandremovedfromthefacilitybyCONTRACTORatOWNERSsdiscretionand transportationexpense. 7.OWNERsPropoerty Unlessotherwiseagreedinwriting,alldrawings,specificationsandanyotherproperty furnishedtoCONTRACTORbyOWNERorpaidforbyOWNERforuseintheperformance ofthisRenovationshallbeandremainthesolepropertyofOWNER. 8.QualityAssurance CONTRACTORwarrantsthatthequalityofconstructionworkpursuanttothis ResidentialHouseRenovationshallbeofgoodworkmanship,freefromdefects,and shallconformtothespecifications,drawingsorsamplesspecifiedorfurnishedby OWNER.Thiswarrantyshallsurviveanyinspection,delivery,acceptanceorpaymentby OWNER.

9.RightofInspection. OWNERshallhavetherighttoinspecttheHouseRenovationServicesatOWNERs facility.OWNERmustgivenoticetoCONTRACTORofanyclaimwithrespecttothe condition,qualityorgradeoftheHouseRenovationServicesornoncomformanceto thisAGREEMENT,specifyingthebasisoftheclaimindetail.CONTRACTORmay,atits option,inspectOWNERsfacilitiestoconfirmthattheHouseRenovationServicesdonot conform.IntheeventtheHouseRenovationServicesdonotconformtothis AGREEMENT,OWNERssoleremedyandCONTRACTORssoleobligationshallbeat CONTRACTORsoptiontoredotheworkatCONTRACTORsexpense.Ifconstruction materialsaredamagedduetononconformity,CONTRACTORmayusetheavailable surplusmaterials.OWNERshallberesponsibleforadditionalbutconsiderableamount ofmaterialsthatarenotcoveredbytheBillofMaterials,constitutingcustomary quantityvariations,otherthanthoseresultingfromCONTRACTORspoorperformance ornegligence. 10.Assigment. CONTRACTORshallnotdelegateanydutiesnorassignanyrightsorclaimsunderthis ResidentialHouseRepairwithouttheexpresspriorwrittenconsentofOWNER.Any assignmentordelegationmadewithoutOWNERsconsentshallbenullandvoid. 11.CompliancewithLaw. OWNERisresponsibletocomplywiththeprovisionsofalllocallaws,regulations,rules andordinancesapplicablethisResidentialHouseRenovation.CONTRACTORshallbe responsibleforthefairlaborstandardsorstatutesandanystatuteorregulation regulatingoccupationalsafetyandhealth. 12.Notices. AnynoticerequiredbythisAGREEMENTorgiveninconnectionwithit,shallbein writingandshallbegiventotheappropriatepartybypersonaldeliveryorbycertified mail. ThisAGREEMENTshallbeconstruedandenforcedinaccordancewiththelawsofthe Philippines.

14.FinalAgreement. ThisAGREEMENTterminatesandsupersedesallpriorunderstandingsoragreementson thesubjectmatterhereof.ThisAGREEMENTmaybemodifiedonlybyafurtherwriting thatisdulyexecutedbybothparties. 13.Severability. IfanytermofthisAGREEMENTisheldbyacourtofcompetentjurisdictiontobeinvalid orunenforceable,thenthisAGREEMENT,includingalloftheremainingterms,will remaininfullforceandeffectasifsuchinvalidorunenforceabletermhadneverbeen included. 14.Headings. HeadingsusedinthisAGREEMENTareprovidedforconvenienceonlyandshallnotbe usedtoconstruemeaningorintent. APPENDIXA PROJECTSPECIFICATION Constructanextensionofone(1)bedroom(5m.x3.75m.)andone(1)lanai(5m.x 1.25m.),accordingtothefollowingphasesofwork.Thebedroomfloorlevelis0.4m. abovethenaturalgradeline(NGL).Thelanaifloorlevelis1cm.loweranddeclining towardsWestsideby1cm./m.ForitsEastwall,usetheexistingconcretestructureand embedpostsaccordingtothedesign. TheOwnerwilltakecareofthepurchaseofmaterials,exceptinoccasionthatthe Contractorvolunteersforeconomicconsiderations.TheOwnerwilldoitselectricalwork ascoordinatedwiththeContractor.Therefore,Contractorwillperformlaboronlyon lumpsumbasis,accordingtothefollowingphasesofwork.Contractormaysuggestto Ownerimprovementsontheconstruction,butshouldnotdeviatefromthehouseplan normakeadditionalcosts. Lumberfortrusses/beam,corrugatedGIsheetsarereused,windowsanddoorare reused;theOwnermayrequesttheContractortotransportthemfromtheirpresent locationtotheconstructionsite.Allotherpurchasedmaterialsmustbestoredwithin theconstructionsite.TheOwnershallkeeptheownershipofsurplusmaterials.
