Bob Kerrey As discussed on Friday, March 5,2004, Mr. Philip Zelikow would like to
have copies of certain materials currently held in the Commission's "restricted
John F. Lehman access" reading room at CIA headquarters forwarded to the Commission's

offices at 2100 K. Street, NW, Washington DC 20427. The materials that we
would like forwarded to the Commission's office bear bates-stamp page
James R. Thompson numbers 0003942 through 0003986 (the "Covered Documents").

Philip D. Zelikow By this letter, in exchange for CIA's agreement to forward working copies of
EXECUTIVE DIRECTOR the Covered Documents to the Commission's offices at 2100 K. Street, the
Commission agrees to the following:

1. The Commission acknowledges that the Covered Documents are being

forwarded to K Street on a "read and return" basis. That is, the Covered
Documents are being sent to 2100 K Street for the convenience of the
Commission, and once the Commission's staff has completed its review of the
Covered Documents, the Commission will return the Covered Documents and
any copies thereof tcf/n closed by statutpf CIA's Office of General Counsel.

2. In the event that the Commission later requests temporary possession of

any other documents, the Commission will not in any way argue that CIA's
agreement to provide working copies of the Covered Documents in response
to this letter establishes a precedent for future productions of similar
documents to the Commission's office space at 2100 K Street.
