Short View: World Mechanism For Peaceful Dispute Settlement Kim Khorn LONG, MA.

IRs, PUC, 61283, Cambodia August 14, 2013 In 1899 and 1908, there was a world conference in Hague to set up the most important mechanism for peaceful settlement of dispute applied both in the League of Nations and then the United Nations and it was the most of the first initiative mechanism for peaceful settlement are still be practiced until today. Those are included Good office, negotiation, reconciliation, adjudication, mediation, and arbitration. The UN used these mechanisms so I will describe some successful attempts that the settlements have been achieved so far in the global governance. Firstly, the UN is the good office as a venue that give the opportunity to the head of states/ head of the governments the president and the prime minister to exchange view, raise concern and find the support from the allies and help from the legal point of view according to the UN Charter, for example in the Chapter VI. Through the two functions of the UN operational and normative the UN had achieved the great success providing the good office, negotiation, adjudication, mediation, and arbitration for many cases between state and state and between state and world agencies like IMF (International Monetary Fund), World Bank, and etc by providing space for all state-parties involved in the conflict for example the case of Cambodia on Paris Peace Agreement in 1991 & first election in 1993 by UNTAC, Kosovo Civil War, Somalia Genocide. Another examples of successful attempts are mediation that involved the third party NGOs, INGOs, IGOs, and International Community in the mediated process to bring facts, evidences, researches and solutions to the meeting of the conflict parties. For example, without the initiative of the hundred NGOs/ INGOs after the World War I, the League of Nations would not exist and without the mediations of the NGOs/ INGOs after World War II, the United Nations would not exist. So we can conclude that to far extent, the attempts to address the disputes through these mechanisms achieved the very positive results in the history of the UN Global Governance. -END-
