Exemplary damages- are imposed not to enrich one party or impoverish another but to serve

as a deterrent against socially deleterious actions. Art. 2231 provides that exemplary damages may be recovered in cases involving quasi-delicts if the defendant acted with gross negligence (QD-GN). Attorneys Fees: Under Art. 2008 of the Civil Code, attorneys fees may be recovered when, as in the instant case, exemplary damages are awarded.
