ORDER OF DISMISSAL
This matter arises under the Job Training Partnership Act
(JTPA) 29 U.S.C. 1579(a), and the regulations issued thereunder
at 20 C.F.R. 626 et seq.
On December 22, 1989, United States Department of Labor
(DOL) filed a Final Determination regarding the audit of North
American Cultural Center of $2,469 in questioned costs. This
Office issued a Notification of Receipt of Request for Hearing
and Prehearing Order on May 17, 1990. On August 20, 1990, the
North American Indian Cultural Center informed this Office that
it paid the money owed in this matter and was withdrawing its
appeal. The DOL did not object to the withdrawal notice.
On March 1, 1993, this Office issued an Order in which the
parties had twenty (20) days from the date of the order to show
cause why this matter should not be dismissed. In response, the
DOL stated that it did not have objections to the dismissal since
the North American Indian Cultural Center had paid the money
owed. Therefore, it is hereby ORDERED that this appeal of the
Final Determination is dismissed.
