Padilla Facts: Al Caparros Argosino had passed the bar examinations in 1993 but he was denied of taking the Lawyers Oath and to sign the Rolls of Attorneys due to his prior on!i tion of "re kless impruden e resulting in homi ide# from a ha$ing in ident% &e and ' others all pleaded guilty for the death of a neophyte( Raul Camaligan( during a fraternity initiation rites sometime in )eptember 1991% Later in his senten e( he was granted probation by the ourt% &e filed a petition to the )upreme Court praying that he be allowed to take the Lawyers Oath and sign the Rolls of Attorneys% As a proof of the re*uired good moral hara ter he now possess( he presented no less than fifteen +1,- ertifi ations among others from. two +/- senators( fi!e +,- trial ourt 0udges( and six +1- members of religious order% 2n addition( he( together with the others who were on!i ted( organi$ed a s holarship foundation in honor of their ha$ing !i tim% Iss e: 3hether or not 4r% Argosino should be allowed to take the Lawyers Oath( sign the Rolls of Attorneys( and pra ti e law% !eld: 5es( petition is granted% 4r% Argosino had exhibited ompetent proof that he possessed the re*uired good moral hara ter as re*uired before taking the Lawyers Oath and to sign the Rolls of Attorneys( the )upreme Court onsidered the premises that he is not inherently in bad moral fiber% 6he Court is persuaded that 4r% Argosino has exerted all efforts to atone for the death of Raul Camaligan and taking noti e of the general tenden y of youth to be rashm temerarious and un al ulating% 2n gi!ing the benefit of the doubt( 4r% Argosino was finally reminded that the Lawyers Oath is not merely a eremony or formality before the pra ti e of law( and that the ommunity assistan e he had started is expe ted to ontinue in ser!ing the more unfortunate members of the so iety% March 19, 1997
