7I OVERTIME EXEMPT POLICY

1826 Restaurant & Lounge strives to maintain competitive wages for all our employees because we value you and your service to our guests. As part of our pay practices, certain positions within the restaurant are periodically tested for compliance with a portion of the Fair Labor Standards Act commonly referred to as the 7i test. This test verifies whether or not a position is exempt from overtime for hours worked beyond 40 in a given pay week. This exemption applies only to positions that earn more than one and one-half (1 ) times minimum wage and receive more than one-half (1/2) of their total compensation from commissions (service charges.) Positions such as these are exempt from overtime compensation for hours worked over 40 hours per week. Your position was evaluated and it is determined the position qualifies for the exemption from overtime. This exemption is not absolute and we will periodically review throughout your employment in your current position, or any position which meets the above criteria. Your manager, or Human Resources, can provide further information about this law or the 7i test. If you have any questions, please contact Management.
