NATIONAL MCLEAN DAY SCHOOL CLASS ACTION

CLAIMANT INFORMATION UPDATE February 2014 1. Day School Survivors Continue to Seek Justice
As the residential era draws to a close, there remains much work to be done to achieve justice for day school survivors. I continue to be contacted daily by day school survivors who tell me they were abused and hurt deeply when they attended day school. Day Schools were established on or near reserves AT THE SAME TIME AS RESIDENTIAL SCHOOLS to provide education to Indian, Inuit and Mtis children and the purpose of the day schools was to kill the Indian in the child. In 2009, Spiritwind Inc retained Joan Jack Law Office to file a claim in the Manitoba Court of Queens Bench (CI 09-01-62181) and, from 2009 to 2012, with the assistance of many grassroots volunteers, Spiritwind, Joan and her staff were able to collect Initial Contact Forms from thousands of day school survivors who have now registered with this claim. In the fall of 2012, I joined Alghoul & Associates as Special Counsel to work on the day school class action and I also do Indian Residential School IAP claims and practice Aboriginal Law. With respect to the McLean Day School Class Action I filed in 2009, we are continuing the work on the data base and are in the process of the legal analysis of the data. To participate in this claim, call Alghoul & Associates Law Firm toll free at 1877-378-4487 or 204-942-8070 and ask for a copy of the Initial Contact Form.

2. NEXT STEP GRASSROOTS ORGANIZING!

Those involved in the residential school fight know that it took 20 years and many court cases before the residential school settlement agreement was reached. For day schools, we are only just starting. What has to happen is that, in addition to registering with this claim, you have to organize yourselves. We recommend you organize yourselves according to the school you went to instead of where you live today. Once youre organized, give us a call and we can come to your community.

4. COMING IN 2014 THE 3rd ANNUAL MCLEAN DAY SCHOOL CLASS ACTION CONFERENCE
We havent picked firm dates yet, but were thinking about October 21st & 22nd, 2014. In May 2 & 3, 2012, Spiritwind, the Sandy Bay First Nation C&C and Joan Jack Law Office, held the 1st McLean Day School Class Action conference and the 400 or so day scholar and day students attended in Winnipeg, Manitoba.

Left to Right: Kevin Hart, Irvin McIvor, AFN National Chief Atleo, Ray Mason, Louay Alghoul, Joan Jack, Elder Elmer Courchene Then last year, Spiritwind and Alghoul & Associates organized the 2nd Annual McLean Day School Class Action Conference for May 7th & 8th, 2013 in Winnipeg. We had a good turnout and there are many day school students still seeking justice. The deadline for the Indian Residential School Settlement Agreement has passed and while the residential school abuse hearings continue, we must all now turn our attention to helping the day school survivors receive the justice they deserve. Many day school survivors continue to tell me daily that they suffered and they want justice. I look forward to hearing from you soon! Lets keep on, keepin on!
