Rezoning Process

The rezoning process takes approximately 2 months to complete. Property owners must submit an Application for Change of Zoning and submit the application to the Zone Section Office. Once the application is complete and all fees have been paid a zoning section staff will make a zoning case. The zoning case manager will visit the property to take pictures and post a rezoning sign and document the surrounding area uses, neighborhood character, and existing infrastructure. The staff will use this to make recommendations that will be presented at two public hearings. The zoning case is heard first by the Zoning Commission and then a second time by the City council. For all zoning cases, the State of Texas Local Government Code requires public advertisement of the hearing in a newspaper. They also require a mailed notification of the zoning change request to all owners of the property within 200 feet of the subject property. The City of San Antonio will advertise and sends notification prior to the Zoning Commission hearing. They will then advertise and send notifications again before the City Council hearing. The property owner must be present at all public hearings to explain the purpose for the requested zoning change, and to answer questions from the Zoning Commissioners and City Council members. The Zoning Commission hearing includes presentation of the staff recommendation, explanation of the requested zoning change by the property owner and public comments in support of and in opposition to the requested zoning. Then, the Zoning Commissioners vote to determine their recommendation, which will be presented to the City Council. The City Council makes the final decision on all applications for zoning change. The City Council may approve or deny, in total or in part, the requested zoning change. If a change is approved, an ordinance is passed amending the official zoning map to reflect the new zoning district. Ordinances become effective ten days after approval.

Richland Hills Complex is currently a C3 non residential base zoning general commercial. We will submit an application and go through the process to change the plots of land to a mid-rise office (O-1.5) nonresidential base zoning.
