TherehavebeenmanyattemptsbypersonsduringtheopenforumportionsofMVmeetingstogetthosechairing MesquiteVistasMeetingstofollowtheadoptedMeetingProcedureResolution.Thismattercontinuestodeprive propertyownersofanotherrightgrantedintheGoverningDocuments.Thecontinuedignoringoftheruleshas resultedindeterminingthatanofficialcomplaintbesubmitted.Preparationforpresentingthiscomplaintincluded reviewingCDs,meetingminutes,workshop/seminarmaterials,MesquiteVistasandNRSGoverningDocuments. NRS116.3109andNRS116.3106Includerequirementsthatmustbefollowedinconductingmeetingsofthe association.ThesestatutesIncludethatmeetingsmustbeconductedinaccordancewithRobertsRules,orbya resolutionoftheexecutiveboard.ThesubjectofthiscomplaintaddressesonlyoneportionoftheresolutionthatI havechosentoaddress.TheMVMeetingResolutionisveryspecificanditisclearlystated,thattheminutesof eachboardmeetingshallincludethesubstanceofremarksmadebyahomeownerifthehomeowner requeststhattheminutesreflecthis/herremarks.

.Alsoincludedis:Theboardshallattempttoprovide answerstoquestionsraisedbyhomeowners,orindicatethataverbalorwrittenresponsewillbegivenat orbyaspecificdate. NearlyanyMVBoardMeetingcouldbeselectedtopresentthefailurestocomplywiththisresolution.Ihave selectedtheJune20,2013andtheMarch20,2014meetings.AttheopenforumportionoftheJunemeeting questionswereaskedaboutadocumentlabeledBoardResolutionthatwasattachedtotheagenda.The ChairmanandCommunityManagermadeseveralattemptstojustifytheuseofthedocument.Noanswerwas receivedtothespecifichowandwhenquestionsconcerningadoptionofthedocumenttheypresentedandsaid thatitwasaBoardResolution.Additionallytheyfailedtogivethespecificdatewhenaverbalorwrittenresponseto thequestionswouldbegiven,whichisclearlyanotherviolationoftheMesquiteVistasMeetingResolution.Itismy opinionthattheChairmanandCommunityManagerknowinglycommunicatedfalseandmisleadinginformation aboutthisdocumentbeingaBoardResolution.Thecontentwasthenusedtojustifyawardinga$90,000plus contracttoTerraWestwithoutseekingbids.ThisdocumenttitledResolutionOfTheBoardOfDirectorsOf MesquiteVistasCommunityAssociationwasnotaBoardResolutionthenornow.Thisdocumenthasnever appearedonanagenda,intheminutesorbeendistributedtotheOwnersallofwhicharerequiredtocreatea resolution.TheChairmanandtheboardwhenthismattercameupfailedtoanswerquestionsabouttheir involvementorlackofinvolvementorknowledgeinthismatter. AttheMarch20,meetingIandseveralothersrequestedthattheboardmemberssimplyanswerquestionsabout theirinvolvementpertainingtotheletigimlitencyofthedocumentallegedtobearesolutionthatwasusedtojustify theboard'sactionofawardingtheManagementContractwithoutseekingsealedbids.AttheMarchmeetingMr Jonesstatedthathehadnotseenorvotedonadoptionofthisallegedresolution.Theother3boardmembersdid

notrespondtotherequestspertainingtotheirinvolvement.Assurancethatfollowupwouldoccurwas communicatedbytheChairman,thedateforaverbalorwrittenresponsetothequestionswasnotgivenatthe meetingasrequiredbytheresolution.TheMesquiteVistasProceduralBoardResolutionhasbeenignoredagain. Shouldweassumethefailureoftheboardtorespondisbecausethedocumentwasneverpresentedoractedon? Beingtruthfulandethicalistherightthingtodotheownersyourepresentareentitledtotherestofthestory.
