Dissemination of Report of Investigation of Errors and Omissions m Ninety


Applications to the Foreign Intelligence Surveillance Court.

Accompanying this memorandum is the classified report of our investigation of errors and
omissions in ninety applications to the Foreign Intelligence Surveillance Court prepared by the
Federal Bureau of Investigation (FBI) and the Office ofIntelligence Policy and Review (OIPR).
The report sets forth our findings regarding the cause or causes ofthose errors and omissions. It also
offers several suggestions regarding ways to minimize factual errors in Foreign Intelligence
Surveillance Act (FISA) applications that complement the significant remedial measures already
implemented by the Department as a result of the discovery of these errors anci omissions,-. __ ,.,..---- ~

Because of the nature of OPR reports, we generally direct that they be closely' h~ld.' In thi~
case, however, we anticipate that senior department management in the components that are
responsible for the preparation and review ofFISA applications, including OIPR and FBI foreign
intelligence sections, will have an interest in reviewing the report to understand how these errors
occurred and how errors might be minimized in the future. Accordingly, we authorize you to
distribute the report to those senior Department managers who you believe have a need to review
our findings and suggestions.
