It was back then that I purchased and sold surplus at swap meets and flea markets. One day, some kids were running through the flea market and ended up knocking down some of Al's switch-plates. Before Al could get over to his stand and pick them up, a woman slipped on one of them and fell. We all rushed over to assist her, but she quickly jumped up and proclaimed she was okay, just a little embarrassed about the fall. I can remember Al apologizing, and the lady insisting it wasn't his fault; if anything, it was the kids' that were running. No harm done, right? Think again.
I will never forget it. About two weeks later Al called me, very upset, to say that he had been served with a lawsuit accusing him of negligence and demanding punitive damages of tens of thousands of dollars. I was floored. Especially given the fact that it was the lady's kids that had knocked over the items that caused her to slip in the first place.
That law suit took away some of Al's best years. Even though he won it the lawsuit was eventually thrown out of court - the legal fees were astronomical. Al ended up selling all of his inventory for next to nothing, and closed his business' forever. He was never the same after that. It was painful to see something he cherished so much, to be stripped from him. But it woke up something in me at the same time. I remember asking myself, How could such an awful thing happen to such a nice guy? And I couldn't help wondering what would happen to my family if something similar were to happen to me.
Several weeks later, at that same flea market, some of the other venders and I were discussing Al's misfortune, when one of the venders admitted that a similar circumstance had happened to him, but with an entirely different outcome. His lawsuit was dismissed as well. In fact, with a defiant attitude, he admitted that his lawsuit hadn't cost him one brown penny. I couldn't help thinking that he must have had a friend or family member who was an attorney to represent him. But when I asked him, he said No, I have the law firm that I keep on retainer.

1. Have An Attorney Draw Up Your Last Will And Testament (And Update It Every Year). This is the best way to assure that whatever you have goes to whomever you want to have it - when you die. It alone is the single most important Love Letter you can leave to your family with directions intended to protect your current and future assets. Most people never do this, and thus, for many, by the time their estate goes thru probate, it is shredded by the governing authority, sometimes lasting several years and absorbing as much as 50% or more before it is settled. Homes are absolved. One family fought over 3 homes, and after all of the lawyers were done, the family owed more than the 3 homes were worth combined. Future earnings and rewards are erased. There was a woman who died with only a modest savings account. But several years after her death, it was learned that a distant Uncle had died before her, and left her his entire estate, as she was the only living 'next of kin' that the uncle knew of at that time. Only after the woman died, did her family receive notice of her inheritance. And because she had no will, they fought over the hundreds of thousands of dollars until the legal costs had almost swallowed up the entire estate.
2. Have An Attorney Draw Up A Living Will For You. This is your second most important Love Letter to your loved ones. If the unthinkable were to happen, and my life was sustained by machine, I wouldn't want my spouse or children stressing over whether or not they made the right decision. You have the ability to make that decision right now, and avoid putting your family in that dreaded situation. Years ago, a young lady was in a terrible accident, and lie in a coma, on life support. While her husband wanted her removed from the machine keeping her alive, her parents didn't. And the legal battle went on several months, until when she finally had died, all of her life insurance, a million dollars, was absorbed in attorney fees, leaving nothing to her children. And more than that, a family was ruined.
3. Always Seek Legal Advise Before Signing A Contract or Adhering to An Official Document. We all know the old saying that goes something like this: The Bold Print Giveth, And The Fine Print Taketh Away. You see, wealthy people never sign anything before it goes their attorney for review. Why? Well, ask yourself, who's interests is that contract really drawn up to protect? Imagine the power that lies with you when you say to the car loan officer, Looks good, but first, let me fax it over to my law firm and have them look it over. The sad fact is most average people never do this and many times subject themselves to the horrors of losing a home to foreclosure, or having a car repossessed, or being penalized for terminating a cell phone contract. The list goes on and on. What would you do if you received an official government document stating that your street has been rezoned as commercial, causing your property taxes to soar? Or what would you do if you received a document stating that your new condo builder was bankrupt, and you were now in jeopardy of losing your initial deposit? Things like this happen everyday and most people just accept it, not knowing if there is anything they can do.
4. Never write your own letter or make more than one phone call when trying to settle a dispute. Have your attorney write it and make the call. When you have a dispute, get a legal professional to address it. This is what wealthy people do to replace the bottle of Tylenol for the everyday headaches that we face. When the home improvement company is 3 weeks past the completion date, and yet refuses to renegotiate the final payment, have your attorney write the letter and place the follow-up phone call. Or on the flip side, when the vender fails to deliver your product on the promised date, and still requires full payment, engage your attorney to address the matter. Believe me, unless you are an attorney, no letter you or I could ever write will hold the power and garner and respect that an attorney's letter will. When a letter of dispute arrives from a law firm, it generally gets one's attention. Years ago, I was visiting my mother in the country with my daughters. The girls had gone for a ride on their scooters, down a long county road. As my mother and I sat on the country porch, all of a sudden, we could see them from afar, running back towards the house. I dodged off the porch, jumped into the car and drove towards them. As I got closer, I could see a big dog chasing them. I quickly opened the passenger door and the girls jumped in. They were frantic, crying in between taking deep breaths. I could see the dog had one of my daughter's tennis shoes in its mouth. I drove to the neighbors to alert them that their dog was loose, and requested my
daughters' shoe. They became very belligerent and demanded I immediately get the *bleep* off of their property. I couldn't believe it! My mother later told me that she could no longer take her morning Appreciation walks because the dog was always on the loose. We called the police, and they referred us to animal control. So we called the dog catcher, and to our dismay, he claimed to be the only one covering the whole county, and thus, really couldn't do much. Since we had this legal coverage, we called our law firm. They launched an investigation where they discovered that the neighbors were renters. They researched to find the owner of the property and sent him a letter. Needless to say, shortly after that, my mother could enjoy her morning Appreciation walks again, as the neighbor apologized and promised to keep the dog secured in their yard. This is just one of several letters that the law firm has written on my family's behalf over the past 20 years.
5. Whenever Going Before A Judge Or Magistrate, Always Arrive With Your Attorney, And Let Him Or Her Speak On Your Behalf. The person who represents themselves in court, has a fool for a lawyer. I don't know who coined that phrase, but you see it happen every day. It makes good sense when you think of this in terms of criminal cases. But it is also true for the little matters like traffic court. Spend a day in traffic court and watch all of the defendants that shake nervously in hopes that the police officer that issued them the speeding ticket doesn't show up. And when he does, the defendants try and appease the judge with big words and long explanations. Usually this just irritates the judge to the point that you know by the time its your turn, you are doomed. I haven't received a traffic ticket in over 5 years (knock on wood), but I can tell you that there was a period about 8 years ago where I received 7 traffic tickets in a 3 year stretch. We all speed at times, and sooner or later, your number comes up. I think I had the potential to receive a total of 15 points. Can you imagine how much my insurance rate increased with 5 points? Nada...That's rightNOTHING...because I didn't even receive 1 point for all of those tickets. Each time I arrived at court I met my attorney, and my case went something like this. When the morning (or afternoon) started, the clerk ran down the docket, and instructed those with legal representation to say so when their name was called. The few people, who had hired an attorney, were moved to the front of the docket. So right off the bat, I saved hours of time. Now why would the court do this? The truth is it has NOTHING to do with you. It has everything to do with your attorney. It's called courtesy. You see, that judge is a member of the Bar, just like your attorney is. Now I can't say that I
never paid a reduced fine, or maybe just paid court costs, but I can say I never, not once, received points against my driving record. So every year when my insurance came up for renewal, I was treated like the best drivers, and received the discounts and benefits that went along with that. Now, please also consider that I have teenagers. If you have teenagers, you already know what happens to your car insurance when they start driving. And what would happen to your insurance rates if they were to get a traffic ticket and receive points on their driving record? Enough said.
6. Never, Ever, Ever, Show Up To An IRS Audit Alone (Or Just With Your Tax Preparer). Always Bring Your Tax Attorney. This one is a no-brain-er. If you show up to an audit alone, an IRS agent could potentially ask you questions that could have you liable-ling yourself, and you wouldn't even know it.
