I have been aware of and have attended many of the public meetings that have been held

to evaluate the petition of Newport Materials to build, maintain and operate an Asphalt
Plant at 540 Groton Road. These public hearings have been held by both the Board of
Health and the Planning Board.

My impressions of all these meetings are as follows:


➢ The Town of Westford has gone beyond reasonable to accommodate Newport
Materials in their presentations for approval.
➢ The Town of Westford has asked the right questions and requested the correct
studies.
➢ The Town of Westford has turned the simple English of the town's zoning bylaw
pertaining to “Light Manufacturing” into social controversy that may never be
forgotten.
➢ Newport Materials, through their representations, have capitalized on the inability
of Westford to interpret it's own bylaws.
➢ Newport Materials have consistently claimed that they have complied with every
request and requirement that the town has asked for.
➢ Newport Materials has supplied reports, evaluations and opinions in formats that
fill the letter of their application mandates but the spirit is lacking in that their
PDF documents are not digitally searchable by either the town or the general
public.
➢ Newport Materials has not met the legal requirements of abuttal notification of
intent.
➢ Newport Materials consistently changes standards of measurements of simple
statements into a complex legal exercise that require intrepretation. (ie; 6 months
to 200 days).
➢ Newport Materials maintains an attutude that condiciends to the concerned
citizens that attend the meetings and appeases the town authority that oversees the
application process. Unless the town threatens or implies to protect the health,
safety and welfare of the citizens. Then Newport Materials threatens to sue.
Generally, these impressions are unfavorable to Newport Materials and disappointing
toward Westford authorities.

My conclusions are that the process should be terminated at this point for a number of
reasons. They include:
● Westford will not gain any additional revenue and probably lose revenue due to
abbutters requesting tax abatements.
● The simple facts that Westford requested and Newport Materials supplied
scientific reports on Air, Water Quality, Traffic Evaluations, Fire and Safety
evaluations is Prima Facia evidence that the proposed plant is not a “Light
Manufacturing” operation and infact not suited for location in Westford.
