Heard learned counsel for the parties.

Learned Special Government Advocate appearing for the respondents at the outset invited my attention to Section 4-B of the Karnataka Scheduled Castes, Scheduled Tribes & Other Backward Classes (Reservation of Appointment, etc.), Act 1990 and submitted that the order dated 1.8.2012, impugned in the present writ petition passed by the second respondent, is appealable.
3. Having confronted with this, learned counsel for the petitioner prays for the withdrawal of this writ petition with liberty to file an appeal against the order dated 1.8.2012.
3 4. The petition is disposed of as withdrawn with liberty as prayed. If an appeal is filed by the petitioner within two weeks, the same may be considered and disposed of in accordance with law without entering into the issue of limitation.
