Subject matter
Relates to definitions.
Section 2(f) defines information as any material in any form including documents, records, emails,
publications, CD, diskettes etc, which can be inspected by a Public Authority.
Section 2(h) defines a public authority as any body created by the constitution or by the laws made
by a Govt and includes NGOs run by Govt.
Provides that every citizen shall have the right to access information.
Puts an obligation on Public authorities to provide information , maintain records, publish
information of particulars and functins of organization within 120 days of enactment
Provides the machinery for grant of access to information by designating Central Publlic
Infromation officers (CPIO) and State Public Information Officers (SPIO) within 100 days of
enactment.
Request for obtaining information can be filed in written or electronically
The information shall be provided within 30 days of request and can be extended upto 40 days
where third party interest are involved. Information related to liberty of a person it can be obatine
din 48 hours.
Information affecting Sovereignity of India, Security, strategic, scientific and economic interest of a
state is forbidden from disclosure. Secret information and cabinet informations cannot be
obtained.
Information may not be provided if it involves infringement of copyright of an individual
Severability: If some part of record is exempt from disclosure, then information of other parts can
be obtained.
Information related to third party can be provided.
Non judicial machinery: Power conferred on Central Government to constitute a body - Central
Information Commission
Non judicial machinery: Power conferred on State Government to constitute a body - State
Information Comission
Two tier appellate Forum: First appeal can be made to Senior Office to PIO and a second appeal
can be made to Central Information Commission or State Information Commissiion
Penalities: Rs. 250/- per day till application is received or infromation is furnished and shall not
exceed RS. 25,000/-.
Jurisdiction of court: The court has no jurisdiction to deal with complaint, appeal, etc.
