Brillantes vs.

COMELEC (2004)
Petitioners are urging the Court to declare null and void and ultimately prevent COMELEC from implementing
AES, an electronic system of validating and counting votes for the election. Particularly its results with regard to
the President and Vice-President positions, they assailed that it violates Article VII, Section 4 of the Constitution
that gives Congress the exclusive power to canvass the votes for the aforementioned positions. Furthermore, the
implementation is violative of Article VI, Section 25(5) of the Constitution as it will use public money without its
inclusion in any appropriations bill. The Court granted the petition and agreed with the petitioners contention.
