FACTS:
Linnie a Texas national, died in Iloilo City leaving a will where he bequeathed all his property to
his husband Charleston with a provision that upon the death of Charleston, her estate shall go to her
siblings.
Before the death of Charleston, he executed an affidavit that no property had passed to him as
surviving spouse of Linnie except for the purpose of administering such property and distribute the
same to her heirs.
PCIB was made administrator of Charleston estate while a certain Magno for the estate of
Lalaine. PCIB asserts that only of the conjugal property shall pass to the heirs while for Magno under
the Texas law which does not recognized legitime, 50% of the conjugal property shall pass to Linnies
siblings
ISSUE:
Whether the distribution of Linnie estate should be governed by the laws of the Philippines or
those of Texas.
