Facts
January 20 1994 Babbir Singh was hired as a
mechanic for a large national automobile service
station (Listed Company).
Babbir Singh Job was scheduled at 7a.m.
Babbir Singh use to come late for work several
times.
Babbir was permitted to come at 8 a.m instead
of 7 a.m.

Facts
A notice saying any employee being late for
work for more than thrice in any particular
month is subject to termination was displayed.
Babbir was warned and he had signed such
acknowledgement letter.
Due to this continuous behaviour, he was fired.
Then, with union representative he demanded
for job.

What is your position with regard this case? Is


everything in order ? Who is at fault?

Who would you do if you were to decide the


case? Would you punish Babbir or let him go
off the hook?

Facts
Mr. Nandkishore is a workman employed in
the despatch department of a cement factory
and an office bearer of the unrecognised union.

Mr. Nandkishore fell down from the ladder


while working in second shift.
Accident report was sent to commissioner
under worksmens compensation act to
determine the amount of compensation.

Management paid Rs. 3000 as advance but in


return undertaking that this amount will be
deducted from the compensation payable.

The medical report did not mention any kind


of diablement
(Full/Partial,Temporary/Permananet)
On receipt from commissioner management
asked the workman to pay Rs.3000 , given as
advance.

Union was against the decision of management


and wanted that management should treat the
amount as ex gratia payment as accident
occured in the course of employment.

What is the problem in the case?


Analyse the causes which led to the problem.
How should one deal with such a situation?
