Kinds:
A. Culpa Contrctual
- Art. 1170-1174, NCC
B. Culpa Aquiliana
- Art. 2176 NCC, 1172-1174 may also be applicable to QD.
- Requisites:
1. Act/ omission constituting fault/ negligence
2. Damage caused by th asid act or omission
3. Causal relation betwenn the damage and the act/ omission
4. Absence of contractual relation (may be superfluous)

Cupla Criminal
Art. 365, RPC
Reckless imprudence: voluntary but without malice
Simple imprudence: lack of precaution
Elements:
Offender does/ fails to do an act
Doing/ failing voluntarily
Without malice
Material damage results from reckless imprudence
Inexcusable lack of precaution
Distinctions:

1. Aquiliana v Contractual
Contractual: source of liability is contract; arises from breach
Aquiliana: independent from contract
2. Aquiliana v Criminal
Criminal:
6. Culpa that substantive and independent a source of obligation
7. Culpa that an incident in the performance of an obligation thats already existing
