There is a rule for the insurance company that unless there is negligence of the pilot
and/or airline staffs in the occurrence of any accident, the insurance payment
cannot be done.
As per the data shown above in Tableau, 1549 plane accident in 2009 happened
purely because of bird strike and not because of the pilots negligence. Pilots were
not even warned of the possibility of bird strike. Both the engines got damaged after
2-10 birds strike the plane. Hence, it is not the negligence of the US Airways team
but an unfortunate event. Moreover, there is no human fatality happened. Every
passenger was safe.
Hence, there is no legal obligation for the insurer to pay for the claims.
