Dear Mr. Arrigo:
Reference your Freedom of Information Act (FOIA) request dated March 4, 2013, requesting
information related to the Corps’ vegetation policy. Specifically, you seek:
1) Any communication by the U.S. Army Corps of Engineers to authorities of the State of
Louisiana requiring the state to increase its real estate interest along levees statewide to
accommodate the Corps’ vegetation policy as was done by the Louisiana Legislature in 2011.
2) Any communication from the U.S. Army Corps of Engineers to authorities of Louisiana
indicating a state wide threat to levee certification due to Louisiana's pre-2011 6 foot real
estate interest for existing vegetation-free inspection zones.
After a diligent search of the files of the New Orleans District, records responsive to item |
of your request were located, reviewed and deemed releasable in their entirety. ‘The records are
enclosed. No records in response to item 2 of your request were located.

item two is considered denied based on a “no records” determination, You are advised of your right
to appeal this determination through this office to the Army General Counsel. The appeal must be
received within 60 days of the date of this letter. Both the appeal and the envelope must bear the
notation “Freedom of Information Act Appeal” and should be sent to this office.
‘The fee for processing your request is $44.00. This fee is based on | hour of searching,
collecting, and approval for a technical grade GS-9/15 @ $44.00 per hour. Please remit a check or
