Political Law

Constitutional Law

Genuine political question. An act which is within the exclusive control of the
executive or legislative branch (purely executive or legislative). The judicial
branch has no power to revise even the most arbitrary and unfair action of
the other branches of government taken in pursuance of the power
committed exclusively to that branch by the constitution. GADALEJ cannot be
invoked by the court to exercise judicial review over acts which are purely
legislative or executive. (Alejandrino v Quezon). Whether such power has
been wisely or correctly exercised is usually beyond the ken of judicial
determination.

Election law

Electoral Tribunal has jurisdiction only with respect to all contests relating to
the election of members of the legislative. However, the congress remains to
be the sole judge of the election, returns and qualifications of its members.
Election contest refers to statutory contests in which the contestant seeks not
only to oust the intruder but also to have himself inducted into office.
