BUS DEPOT GHATRKUPAR ( EAST a FOREWORD The Municipal Gorporation of Greater Bombay is an autonomous Body, established under the provisions of Bombay Municipal Corporation Act, 1888 to administer the Civic affairs of the Bombay City. The Municipal Commissioner is the chiet Executive Head of this Body and is responsible tor providing and maintaining civic services in the City. As per the provisions of Bombay Town Planning Act. 1954, i was neccessary for the Muniuipal Corporation to prepare a Development Plan for Greater Bombay area. Such a plan was, therefore, prepared which came into force in 1967. This Development Plan was fora period of twenty years i.e. 1961 to 1981. This Development Plan however , was not effective as it did not involve any public participation and relied entirely on the Municipal Corporation to generate resources to meet the cost of acquisition of land, removal of encumbrancos and development ofthe amonities. Moruover , thero wore no specific provisions available to raise the funds solely for the purpose of implementation of the Development Plan. Keeping In view of the short coming of the First Development Plan, the Municipal Corporation has now revised the said Development Plan . The revised Development Plan has already cume into torce & is effective upto year 2001. This plan involves public participation & there are such provisions in the said Development Plan and the Development Control Regula tions. 1991, sanctioned alorywith the said plan that it would be possible now for the Municipal Corporation to implement the said plan without much financial liability, Ilis felt that the citizens should be made aware of the broad outline of the Development Plan & the Development Control Regulation, 1991, so that they would be able to understand & participate more effectively in the implementation of the said Development Plan. For the sake of convenience & to make it more effective , it is proposed to prepare a booklet Know Your Ward Development Plan’ for each municipal administrative ward & print it for the benefit of general public. We have great pleasure to publish the booklet in this series tited ‘Know Your Developinent Pian tor N - Ward’. We are sure that it will help citizens to understand the basic characteristics of N- Ward, the amenities already existing in the ward andtheamenities proposed tobe developedin the Revised sanctioned Development Plan It is hoped that the citizens would maketull uso of this booklet and help the Municipal Corporation in Implementing the Development Plan for betterment of this great Metropolis, N.ZURALE —A.N. Kale SUDHA BHAVE S.G.KALE CHER) DIR (E.S&P) ADDL MUNICIPAL COMMISIONER MUNICIPAL COMMISIONER KNOW YOUR WARD DEVELOPMENT PLAN “N" WARD 1 Three and half centuries ago, Bombay was a group of 7 tiny islande pre- dominantly inhabited by kolis and the main trades wre fishing , agriculture and coconut plantation etc. In 1667, these Islands wore taken on lease by East India Company, for tho purpose of trade andl commorce. They established a part being the most suitable ‘ocationandthe same was constnicted whore the Gateway of India stands today. This started the developemnt of Bombay city, which has now grown into Metropolis Earlier the limit of Municipal Corpo- ration was confined to city area only, The suburban areas which are now comprised of L, M,N, H & K Wards were merged and brought within the jurisdiction of the Gorpo- ration in the year 1950, Whereas the ex- tended Suburbs areas comprising of S,T.P, &"R" Wards were merged within the corpo- ration limit in the year 1957. With the pas- ‘sage of time with all around develepment the area within the jurisdiction of the corporation now called as Greater Bombay has grown into the great Metropolis with the population of around 1 crore. The City has been divided into ad. ministrative wards for the purpose of local administration. With the passage of the time, larger wards were subsequently sub-divided and today there are 23 administrative wards for the purpose of Local Administration. The 'N' Wardis one of the ward, situated in North easter part of the suburbs, It admeasures about 25.96 Sq.Km in area The boundaries of 'N' Ward are as under :- (tast)- Thane Creek, (West) - From Netaji Palkar Marg along Ghatkopar and Vikroli Hills upto Varsha Nagar of Park Site Colony, (North) - From the end of Varsihia Nagar alongthe western bourutary ot Godrej Co., 1/th Road, (Park Site Culony) along L.B.S.Marg meeting Vikroli Station, (West) - Upto Vikroli Station & along Phirozshah — ss Godrej Marg upto the Nalla and Thane Crook South to Kannamwar Nagar, (South) - Netaji palkarMary, Khalaivilago, NathaiiiSleel Yard, South of Chitranjan Nagar, Hindu Cemetry upto the nalla near Ghatkopar Pumping Sta- tion, Asperthe census of year 1991, Popii- lation of 'N' Ward is 5,10,708, 2. CHARACTERISTICS ; The entire arna of 'N' ward Is bitui- cated into 2 parts by central railway line. 'N’ ward comprising of small villages like, Ghatkopar, Kirol, Vikroli and Khalai village. The entire 'N’ Ward has been beautifully de- veloped with broad rads, buildings with beat tiful elevation and number of Playgrounds and Gardens. Ghatkopar and Vidyavihar are 2 Railway Stations in this ward Vidyavihar is fast developing into a beautiful township. One of the largest Educational Complex having all required facilities known as "“Somaiya Vidya vihar’ is situted at Vidyavihar East. Large M.H.B. Housing colony known as Pant nagar colony is situated ata Ghatkopar East. Major portion of the 'N' Ward is developed will: resiciential development. The T.P.Schemesof Ghatkopar added{o the planneddevelopment of the Ghatkopar. One of the largest well known Mig. unit of the country ie " Godre} & Boyce Co." is situated in'N' Ward. A textile Institute, imparting knowledge of Textile In dustry is also located in this ward. 2.4: 'N' Ward being centrally situated in eastern suburbs, the Road Transpon Office, eastern suburbs division is situated in this ward, giving great relief to the residents stay. ingin Eastern Suburbs. The Rajawadl, Munict pal Hospital with coroner facility and other charitable hospitals viz Sarvodaya Hospital etc, located in 'N’ Ward, provides medical facility not only to the local residents but also palronised hy the residents of wastern sub- turbs and people: even staying out of Bombay along this corridor. The Municipal Swimming Poolat Ghatkopar(East) and Jolly Gymkhana, run bya Trust al Vidyavihar are the two major recreational facilities inthis ward. | hereis also N2 a vihar Traffic Park situated along M.G Road opposite Hinducemetry developed by Lions Club with the help of Traffic depart ment Which gives knowledge regarding vari- ous traffic patterns, 2.2+ ‘Thore are two large colonies devel- opedbytheM.C.G.Bviz"BarveNagar Colony’ at Bhatwaui Ghatkopar and Park Site colony at vikroli. There is also a big residential colony "Pant Nagar’ developed by M.H.B at Ghatkopar (East). The Garodia Nagar situ ated between Ghatkopar (East) & Vidyavihar (East) is well developed private layout 2.3: Ghatkopar's nicely developed partly dueto implementation of T,P.Scheme,II & Ill T.P.Scheme Ghatkopar(I), (Final) was sanc tioned by the state Govt, to take effect from 1.1.1962, having scheme area 16 acres T.P.Scheme Ghatkopar (II), 2nd Variation has been sanctioned to take effect trom 2.12.1970, having scheme area 32.70 acres, (Out of this major portion i.e about 20 acres is in possession of Gentral Govt, since 1945. Part of these area has been requisitioned and some areas have been acquired by them for construction of the staff quarters and Godown of the Director of Supplies and Disposals T.P.Scheme — Ghatkopar(|I!) T.P.Scheme is in force since 1.5.1985, com. prising of an area of 208 acres of land. a Thearterialroads namely L.B.S.Marg, EE Highway and Ghatkopar- Andheri Link Road are the major Road network connecting the area of Western Suburbs & City. 3. DEVELOPMENT PLAN 1967 : As per the provisions of the Bomaby Town Planning Act 1954, The Development Planof Greater Bombay was first prepared by the Municipal Corporation for the areas within their jurladiction. Ihe development Plan of various wards were sanctioned by the Gov- ernment trom 1965 to 1967. Accordingly, The Development Plan of 'N' ward was sanctioned in the year 1967. The Development plan in- cluded zoning for residential, commercial, industrial and-no development zone. It also includes reservations for various public ameni ties and utilities and proper network of pro posed roads. 3.1: Duetotinancial stringencies and other constraints the development plan of 1967 could be implemented to a very smaill extent by the Municipal Corporation. As a result only very few reservations could be developed in this ward. 4. REVISED DEVELOPMENT PLAN 1991; « Atter sanctioning of the earlier devel opment plan there werg number of changes in poliuies which were taken into account while Preparing the development plan. Further, inthe mean time the M.R.&T.P Act came into force replacing Bombay Town Planning Act, 1964. which also provides for appointment of a Re: gional Authority. The Govt, thereforeappointed Bombay Metropolitan Regional Development Authority to look after the development of vari ous alvas surrounding Bombay and also laid down policies and guidelines for development within city of Bombay. Taking into consideration these changes and being obligatory function under the M.R.&T.P Act, the development plan of Greater Bombay has been revised, which has been sanctioned by the Government from time to time in the recent past. The sanctioned revised developrnent plan of 'N’ Ward, came into force from 1st June 1993. 4. The state Government has also sanc- tioned the Development Control Regulations, 1991, and the same came into force from 25.3.1991 4 The List of existing amenities and sites teserved for proposed amenities is yiven in Appendix!. Thisisa summary atatemunt which includes the number of the existing and pro: posed amenities and the corresponding area in sq.mt, Further the entire 'N' Ward Is having 43.90% Residential Zone, 45.03% No Devel: ‘opment Zone, 8.74% Industrial Zone, and only 2.33% Commercial Zone, 5.IMPLEMENTATION OF REVISED DEVELOPMENT PLAN - 1991 Therevised development plan, 1991 is for aperiod of 20 years from 1981 to 2001 Due to several deifficultivs, the plancouldbe sanctioned by only in 1993 and as such, the time available for implementation is about 7 years from now on. The Municipal Corpora tion is the implementing Authority and it will be neccessary for the Municipal Corporation to prepare a phase-wise programme to de velop the amenities shown in the develop. ment plan within a span of 7 years 6. MECHANISM FOR DEVELOPMENT The proposed amenity can be de- veloped in the following manner 6.1: The Municipal Corporation can ac quiré the plot under the provisions uf the M.R.8T.P.Act, remove the encumbrances thereon by rehabilitating the authorised oc. cupants elsewhere and developingthe ame nity as per the requirement of the local ‘SOMAIYA LAYOUT, VIDHYAVIMAR population. The Corporation has to incur the cost of acquisition, rehabilitation, and development. This was thebasicprinciple adopted for implementation of the devel: opment pian sanctioned in 1967. As the Municipal Corporation could not provide adequate financial resources, the amen ties could not be deveioped to the desired extent. In order to facilitate development of vatious publicamenities andfacilities spe cific provisions have been made in D.C.Regulations which will speed up the developmentof such reserved sitestor the specific purpnses without incurring any expenditure by the Corporation and will minimise acquisition procedure which is costly and time consuming 6.2: Under the D.C.Regulation No 9 list of public amenities has been given which can be developed by the owner and handed over to the Municipal Corporation or other Apprapri ato Authorities as the case may be Na free of cost . The owner can then develop the plot for the permissible users in the zone, to its fullest extent (treating the amenity free of F..1). Thus, the Municipal Corporation of the Appropriate Authority wiliget the constructed amenity without incurring any expunditure, ‘The Said regulation also empower the Mu- hicijial Corporations to hand over the con structed amenity to any 1egistergd institution or trust for operation and maintenence. Due tothis regulation, many reservations suchas Shopping Centre, Retail Markets, parking lot Dispensary, Health/Welfare Centre, Mater nity Home, Municipal chowky, General Hos- pital, Library etc. will he available to eurpora tion for benefit of public at large. 6.3: An important provison has been made under the D.C,Regulation No.34 for grant of "Transferable Development Rights’ (T.D.R) under this provision, if the owner removes the encumbrances on the plot un- der reservation, levels the same, puts a com pound wall with agate and hands it overtothe Municipal Corporation or the state Govern ment as the case may be, free of cost, he is entitled to get the development rights in the form of full F.S.1., of the plot handed over, to be used elsewhere. For the purpose of utilisation of this transferable F.S.1., the Greater Bombay areais divided into 2 zones, ie Receiving zone and Non- receiving zone. As such, transferable F.S.\. can beused only inthe receiving zone. The entire cityand the area between S.V.Road and Western Ex- press Highway in the westem suburbs and area between Lal Bahadur Shastri Marg and Central Railway Main Line, in the Eastern Suburbs have been placed in the Non- teceiveing zone. The Tansferable F.S.1., therefore, will not be allowed (o be used in these areas, This provision will enable the’ Municipal Corporation /State Government to take over the plots free of cost and froa of ‘encunibrances and afterwhich the benefit of D.C.Regulation No. 9 (accomadation reser- vation) is not available, 6.3.1: TheD.C.Regulation No.34alsoallow the owners to hand over the plot as specified above alongwith constructed amenity thereat,as por the requirement of the con- cerned authority Under such circumstances, the ownwr is entitledto have further additional F.S.1 (Tratistorable) equivalant to the buill up area of theamenity constructed. This Regula- tion No.34 not only provides taking over the reserved plot free of cost but also enable the concerned authority to get the amenity con: structed thereon free of cost 6.3.2 As taraa'N’ Want is concorned,the same being centrally located in eastern eub- Urbs, the provision of T.D.R canbe used ina better manner. Further 'N’ ward being devel ‘oping ward, itis likely that many of the reser- vations will be developed and will come in Municipal possession by way of T.D.R. 6.4: As regards sites reserved for public housing/ high density housing, D.C. Regulation No.9 allows the reservation lo be devioped by the owner subject to cerlain conditions, The most important condition being that 10% of the tenements of 180 sq ft, carpet area to be handed over to the Municipal Corporation for accommodating the project affected people Who are required to be shifted due to develop- ment of reservation, including widening of roads etc. The owner, however, is entitled to get construction cost of each tenement plus 15% profit thereon . Public housing reserva tion in the ward could be developed by taking advantage of this provision. 7.AUTHORITIES RESPONSIBLE FOR IMPLEMENTATION Since the revised development plan is requiredto be implemented within a span of 7 years, it is necvessary that a proper phase Wise programme is prepared taking into con- sideration the privrilies of the local population. {tis, therefore, advisable that the entire ward is divided into suitable sectors and the priori tivs are tixed for development of amenities therein. Based on these sectonwise priorities, @ final priority list for the entire ward can be prepared. Since the preparation of the priority list is directly related to the local needs, the W.Os/Zonal D.M,Cs. should prepare such a priority list in consultation with sectional heads in the ward and the local councilors, elected representatives and local community. 7.1: The office of the Chief Engineer. (Development Plan) will prepare yearwise priority for availing T.D.R and. publish the same forthe benefit of owners of the reserved plots (such publications of yearly priority list for availing T.D.R. is obligatory under the provisions of D.C. Regulation No.34), 7.2: _ Itwillalsu be necessary totake timely steps to develop the plots made available under T.D.H. facility or to put to use the constructed amenity either under T.D.R. facil- ity or under accommodation reservation. The zonal D.M.C.,W.O. andthe Local Councillors will have to take lead and play a constructive role in fuller implementation of the Develop- ment Plan of the Ward there by making avail able amenities and facilities to the residents of the locality.
