1 Pursuant to Civil Local Rule 7-10(b) and Civil Local Rule 79-5, plaintiff Google Inc.

2 (“Google”) hereby requests that the Court permit it to file under seal Exhibits A and B to the

3 Declaration of David H. Kramer in Support of Google Inc.’s Opposition to Affinity Engines,

4 Inc.’s Motion to Dismiss and/or Stay Proceedings (“Kramer Declaration”).

5 Exhibits A and B to the Kramer Declaration are documents produced by Google in the

6 state court action Affinity Engines, Inc. v. Google Inc., Santa Clara County Superior Court, Case

7 No. 104CV020368. These documents constitute employment information concerning one of

8 Google’s employees. Exhibits A and B have been designated “Highly Confidential – Attorneys’

9 Eyes Only” pursuant to the Protective Order entered in that matter on August 23, 2004.

10 For these reasons, Google requests an order permitting it to file Exhibits A and B to the

11 Kramer Declaration under seal.
