(Central Act LXill of 1948), the Governor of Tamil Nadu hereby makes the following amendment to the Factories Rules, 1950
the draft of the same having been previously published as required by Section 115 of the said Act
AMENOMENT
In the said Rules, difler Rule 80, the following Rules shall be inserted, namely:—

82. Persons employed in a confidential position— (a) The following categories of Persons shall be deemed to be

83. List to be maintained of persons holding confidential positions or supervision or management—A list showing the
‘names and designations of all persons to whom the provision of sub-section (1) of Section 64 have been applied shall
be maintained In evory factory.
84. Exemption of certain adult workers.— (a) Adult workers engaged in factories specified in Column (2) of the
Schedule to this Rule on the work specified in Column (3) thereof shall be exempted from the provisions of the Sections
specified in Column (4) subject to the conditions, if any, specified in Column (6) of the said Schedule.
(b) Except in the case of urgent repairs covered by item (1) of the Schedule, the exemptions shall be subject to
the following conditions, namely:—
(1) in case of exemption from Sections 51 and §4, no worker shall work for more than ten hours per day or
58 hours per week;
(2) ‘in case of exemption from Section 55, sufficient time, though not a fixed period, shall be given for meais
to the satisfaction of the Inspector of Factories concerned;
(3) in case of exemption trom Section 56, the spread over of hours of work inclusive of intervals for rest shall
not exceed twelve hours in any one day ; and
(4) the total overtime hours worked beyond the limits of nine hours per day and 48 hours per week shall not
exceed 50 hours for such quarter of the calender year.
(c) In the absence of a worker who has failed to report for duty in factories in which any work should be carriod
(on continuously for technical reasons, a shift worker be allowed to work the whole or part of tha subsequent shift Irrespective
of the restrictions imposed In Clauses ()) and (i) of sub-section (4) of Saction 64 of the Act: Provided that:
(1) the next shift of the shiftworker shall not commence, before @ period of wight hours has elapsed;
(2) within 24 hours of the commencement of the subsequent shift notice shall be sent to the Inspector,
explaining the circumstances under which the worker Is required to work in the subsequent shift; and
(3) the exemption will be restricted to only male adult workers.

are hereby published for information of all persons likely to be affected thereby as requitely by Section 115 of the said Act.
2. Notiée is hereby given that the said draft amendments will be taken into consideration on or after the expiry of forty
five days from the date of publication of this Notification in the Tamil Nadu Government Gazelte, and any objection or
suggestion which may be received from any person with respect thereto before the expiry of the aforesaid period will be

In the said Rules, in rule 95 in Schedule XX,
(1) In paragraph 17, after the expression for the purpose, occurting at the end, the following expression shall be
added, namely:
“All factories should adopt the membrane filter test without fail
Explanation.—Membrane Filter Test” is defined as the method for determination of airborne asbestos fibre concentration
in work environment by light mictoscopy Membrane Filter Method";
(2) In paragraph 19, in sub-paragraph (3), after the expression “Health Register in Form 17°. occurring at the end,
the following expression shall be added, namely:—
“The said register containing the health record of every worker shall be maintained by the occupier of the Factory
for a minimum period of forty years from the date of beginning of the employment or fifteen years after retirement or cessation

DRAFT AMENDMENTS TO THE MINIMUM WAGES (TAMIL NADU) RULES, 1953.

No.SRO A-6/2008.—The following draft amendments to the Minimum Wages (Tamil Nadu) Rules, 1953 which it is
Proposed to make in exercise of the powers conferred by Section 30 of the Minimum Wages Act, 1948 (Central Act XI of
4948), Is hereby published for information of all persons likely to be affected thereby as required by sub-section (1) of Section
35 of the said Act
(2) Notice is hereby given that the draft amendment will be taken into consideration on or after the expiry of three
months from the date of publication of this Notification in the Tamil Nadu Government Gazette and that any objection or
suggestion which may be received from any person with respect thereto before the expiry of the aforesaid period will be
considered by the Government of Tamil Nadu. Objection and suggestion, if any, should be addressed to the Principal
Secretary to Government, Labour and Employment Department, Chennai-600 009 through the Commissioner of Labour,
Chennai-600 008.

(1) after rule 28-A, the following rule shall be inserted, namely—
“28-8. Self Centication for Information and Software Establishments. —Employer of every Information Technology
Software Establishment or Information Technology Software enabled service, shall furnish to the Inspector of Labour a hall-
yearly certificate of maintenance of registers, records and notices which are required to be maintained or exhibited under
the provisions of these rules, in Form Xil (in duplicate) The Certificate for the half year ending 30th June shail be furnished
before the 31st July of the year and the Certificate for the half year ending 3st December shall be furnished before the
31st January of the succeeding year;
(2) after FORM XI, the following FORM shall be added, namely:—f

Note.—Employment in L.T.Establishments is not included in the Schedule under the Minimum Wages Act, 1948,
However, they are covered by the Notification of Minimum Wages issued for the employment in Shops and Establishments.
Till such’ time the 1.T.Employment is added to the Schedule under the Minimum Wages Act, 1948 and Minimum rates of
wages are fixed by the Goverment, the Minimum Wages prevailing for the Employment in Shops and Establishments is
applicable to the categories enumerated therein.
