TESDA CIRCULAR Subject: Omnibus Guidelines on Program Number 45s. 2007 Registration under the Unified TVET Page -1_.of ff Pages Program Registration and Accreditation ‘System (UTPRAS)_ Date Issued: Effectivity: Supersedes: TESDA Order Nos. 017 s, December 19, 2007_| As indicated 2000 and 12 s. 2007 | In view of the need to make TVET more responsive and relevant fo the changing requirements of the local and overseas labor market, and in accordance with TESDA Board Resolution No. 2007-52, the following policies and guidelines in program registration under UTPRAS are hereby issued: | 1 LEGAL BASIS Republic Act No. 7796, otherwise known as the TESDA Act of 1994, empowers TESDA to establish and maintain a system of accrediting, coordinating, integrating, monitoring and evaluating formal and non-formal TVET programs. In its regular meeting held on January 23, 1998, the TESDA Board promulgated Resolution No. 98-03 which approved the establishment of UTPRAS in consonance with the pursuit of a quality TVET system. AILTVET programs offered in public and private TV\s shall be subject to program registration under these guidelines. I DEFINITION OF TERMS 1, Technology-based Community Training Program refers to a program covering a full qualification or cluster(s) of units of competencies conducted in the community by public or private TVET institutions or sponsored by local government units, non-government organizations, and other government agencies coordinated by TESDA, 2. Competency-based Curriculum refers to a framework or guide for the subsequent detailed development of competencies, associated methodologies, trainings and assessment resources. It specifies the outcomes which ore consistent with the requirements of the workplace as agreed through the industry or community consultations. 3. No Training Regulation (NTR) refers to programs registered under UTPRAS not covered yet by any promulgated Training Regulations. 4, With Training Regulation (WIR) refers to programs registered under the UTPRAS with the appropriate promulgated Training Regulations os _ — a basis for its registration 5. Certificate of Program Registration refers to the document issued by the Authority to a concerned institution as a manifestation that the TVET program offered complies with the minimum requirements or standards prescribed by the Authority. 6. Institutional Assessment is an assessment undertaken by the institution for ils students to determine ther achievement of the learning ‘outcomes in the modiule of instructions in a given unit of competency or clusters of competencies. Ml. COVERAGE These guidelines shall apply to all TVET programs for a fee, except those covered by apprenticeship, leamership, and dual training system which are covered by separate laws. IM GENERAL POLICIES 1. The online registration process shall be institutionalized in all TESDA Regional/Provinciai/District Offices (ROs/POs/DOs). The original documents shall be presented by the Technical Vocational Institutions (TVis) during the ocular inspection. 2. AIITVET programs shall be registered either WTR or NIR, 3. Programs shall be registered by qualification or cluster of competencies, 4. For some sectors where related qualifications have existing Training Regulations (e.g. Tourism Industry and Information and Communication Technology), program registration sf has to be made by qualification. However, the TVis shall be given the option fo bundle such qualifications into mutti-qualiication programs to produce mult-skilled graduates. 5. The nominal duration indicated in the TR shall be the minimum number of houts for a TVET program, 6. ATVET program shall be governed by the principle of full disclosure in the submission of the following documentary requirements: @.. indications of the units of competency and targeted learning outcomes: b. the manner by which such competencies shall be achieved: . the insfitufional assessment process to determine whether such competencies have been acquired: and d, the range of jobs for which such competencies may apply. 7. A registered TVET program shall be eligible for program accreditation 8. IVI with registered programs under the promulgated TRs maybe accredited as an assessment center or assessment venue provided the requirements and processes of accreditation are complied with, 9. Special Order shall be issued by the POs/DOs to graduates of all registered TVET programs whether WIR or NTR and whether full qualification or in cluster of competencies in privately owned institutions. IV. BASIC PRINCIPLES OF THE REGISTRATION SYSTEM 1. The UTPRAS is primatily intended to promote public interest and welfare by ensuring the quality of all TVET programs; 2. The registration system is anchored on the competency-based system wherein TVET programs adopt the qualification fitles being prepared for and the competency or set of competencies that are to be acquired: 3. The registration system prescribes compliance with minimum. standards provided for in the TRs promulgated by the TESDA Board; 4. The registration system is referenced on the Philippine TVET Qualification and Certification System (PTQCS). As such, TVET programs shall be categorized on the basis of the qualification levels in the Philippine TVET Qualification Framework {PTQF) namely: National Certificate (NC) |, National Certificate (NC} 1, National Cerificate (NC) Ill and National Certificate (NC) IV: 5. The registration system, among others, leads to a more efficient and effective management of the TVET sector. V. REQUIREMENTS FOR REGISTRATION 1. New Applicant Institution TVI applying for program registration for the first time shall be required to submit a certified true copy of the following information ‘and documents: a. CORPORATE AND ADMINISTRATIVE DOCUMENTS + Board Resolution/Academic Council Resolution to offer the program (State Universities and Colleges, Local Colleges and Univerisites, and private institutions} '* Special law creating the institution (for public institutions only) e.g. Republic Act, Executive Order, Sanggunian Resolutions * Security and Exchange Commission (SEC) Registration and ‘Articles of Incorporation (private institutions only) + Proof of building ownership or lease-contract of at least two (2) years © Fire Safety Certificate bb. Additional Program Application For succeeding program application, a TVI shall have passed the program registration evaluation for the initial program(s} registered. The following documents shall be submitted: ‘+ Update on corporate documents, if any (eg. Fire Safety Cerlificate, Proof of Building Ownership } + Competency-based Curriculum (indicating the qualification being addressed and the competencies to be developed) > Curriculum design > Modules of instruction ‘+ Uist of supplies tools and equipment for the program List of instructional materials (books, videotapes, internet access, etc) Ust of faculty for the program and their qualifications Ust of Training Faciliies indicating the floor area Shop layout of training facilities Schedule of Fees VI. REGISTRATION PROCESS A. On-line Registration j 1. The concemed TVI shall fle online and upload the Letter of Application together with the documentary requirements for program registration as mentioned in Section V of this guideline with the TESDA POs/DOs that have jurisdiction over the institution's application at least thirty (30) calendar days before the institution shall offer the program, 2. All ondine applications must be acknowledged on-iine by the POs/DOs within 48 hours upon receipt of the application, days from the time the Acknowledgement Letter is sent to the ‘applicant TVI. A nofification shall be sent to the TVis in the form of a Program Requirement Checklst that indicate the status of the evaluation of the documents submitted/uploaded. 4. The non-refundable registration fee shall be paid during the ‘ocular inspection and properly receipted by TESDA POs/DOs. 5. The UTPRAS Evaluation Team shall undertake curriculum evaluation and inspection and verification of faculty qualifications, training supplies and materials, tools, machines ‘and equipment, site and facilities within thirty (30) calendar days from receipt of the application, in carying out this task, the TESDA POs/DOs shall employ the services of experts. Original documents and one (1) electronic copy of the complete documents must be presented by the TVI during the ocular inspection, 6. An electronic copy of the complete documents together with the results of the inspection, verification, evaluation, and ‘comesponding recommendations of the TESDA POs/D0s shall be forwarded fo the TESDA Regional Office for final review and issuance of Cerificate of Program Registration (CoPR) 7. The TESDA Regional Office shall issue a CoPR indicating whether the program registered is WIR or NTR. 8. An application for TVET program registration shall be disapproved if an institution fails to meet the minimum standards for the Program. In this case, the registration fee is forfeited to underwrite administrative costs incumed. | | 3. POs/DOs shall evaluate all applications within five (5) working 9. The denial of the appiication for registration shail be subject to ‘appeal to the Office of the Director General of TESDA within fitleen (15) working days from the time the letter of denial was _ received by the applicant TVI, The decision of the Director General shall be final and executory. B. Face-to-face Registration 1. The applicant TVI shall file a Letter of Application together with the documentary requirements for program registration as mentioned in Section V of this guideline to the TESDA POs/DOs that have jurisdiction over the institution's application at least thirty (30) calendar days before the institution will offer the program. 2, The POs/DOs shall evaluate all application within five (5) working days from the time the Acknowiedgement Letter is sent to the applicant TVI. A notification shall be sent fo the institution in the form of Program Requirement Checklist indicating the status of the evaluation of the documents submitted, 3. The non-refundable registration fee shall be paid during the ‘cular inspection and properly receipted by the TESDA POs/DOs. 4, The UTPRAS Evaluation Team shall undertake curriculum evaluation and inspection and verification of faculty qualifications, training supplies and materials, tools, machines and equipment, site and facilities within thirty (30) calendar days from receipt of the application. In carrying out this task, the TESDA POs/DOs shall employ the services of experts. Copy of the complete documents together with the results of the inspection, verification, evaluation, and comesponding recommendations of the TESDA POs/DOs shall be forwarded to the TESDA Regional Office for final review and issuance of CoPR 6. The TESDA Regional Office shall issue a CoPR indicating whether the program registered is WTR or NTR. 7. An application for TVET program registration shall be denied if an institution fails to meet the minimum standards for the Program. In this case, the application fee is forfeited to underwtite administrative costs incumed. 8. The denial of the application for registration shall be subject to appeal to the Office of the Director General of TESDA within fifteen (15) working days from the time the letter of denial was received by the applicant IVI. The decision of the Director General shall be final and executory. VII. PROGRAMS COVERED BY TRAINING REGULATIONS 1. TVET programs shall be registered as full qualification programs if they cover all units of competency (basic, common, and core) in the TR. 2. TVET programs covering cluster(s) of units of competency shall be registered based on the prescribed clustering under TESDA Circular No. 01 Series of 2007. 3. Programs which conform in full with the TR shall strictly follow the litle of the qualification and the appropriate NC level in the TR. Example: Animal Production NC 1! with duration of 860 hours 4. Programs covering a cluster of units of competency shall indicate the file in the CoPR per TESDA Circular No. 01 Series 2007 with the phrase “Leading 10” preceding the fitle of the qualification which is being addressed: Example: Raising Poultry Leading to Animal Production NC I | With duration of 196 hours 5. Assessment of students completing a WIR program is mandatory. ‘Such assessment shall be conducted before graduation. | However, passing the assessment is not a requirement for graduation. 6. Programs with employment rate lower than the geographical (regional or provinciall/sectoral average rate for three (3) consecutive batches shall be subject to closure proceedings. VIII PROGRAMS NOT COVERED BY TRAINING REGULATIONS | 1. A program not covered by a TR may be registered as NTR provided it complies with the following: «a. the program must lead foward employment opportunities; bb. the program must satisfy any of the following conditions: 1. the manpower requirement of critical emerging industry or specific area requirements (e.g. Priosity Skils Pian, Provincial Technical Education and Skits Development Plan, industry Studies, Area Development Imperatives, etc.) Ji. the industry with high employment potentials (eg. labor Market Inteligence Report, Philippine ‘Overseas Employment Administration publications, news clippings on job vacancies, Phil Jobnet, etc.) ii, the employment commitment trom enterprises (e.g. Memorandum of Agreements, cerfification from employers, job orders, employment commitments) iv. the regulatory and licensing requirements for the practice of an occupation/protession (Le. Master Electrician, etc.) 2. ATVI applying for registration of an NTR program must show proof of the evidences that the program being applied for | registration satisfies the conditions enumerated in item number 1 3. In addition to the above requirements, a IVI applying for registration of a program being regulated by other national government agencies must submit a certification that it is authorized by such agency to engage in such regulated activity (e.g, Land Transportation Office, Bureau Of Immigration, Department Of Tourism, Department Of Health, Aviation Transportation Office, Philippine National Police, Philippine Amusement and Gaming Corporation} 4, Graduates of NIR programs shall be subjected to institutional competency assessment based on the assessment tools submitied by the TVis and approved by TESDA. 5. NIR programs shall be reviewed after the first three (3) batches of the program based on the employment rate of the graduates which shall not be lower than the regional/sectoral average. NIR programs with certification rates lower than the regional/sectoral average for 3 consecutive batches shall be subject to closure proceedings. IX. PROGRAM REGISTRATION FEES 1, A TVtregistering a program either in full qualification or by cluster of units of competency, whether WTR or NIR, shall pay the non- refundable registration fee of two thousand pesos (P2,000.00) per program | 2. ATV applying for re-registration of programs migrating from NTR to WTR and from WIR to updated WIR shall pay the non- refundable registration fee of two thousand pesos (P2,000.00) per program, 3. TESDA Technology Institutions are exempted to pay the registration fee. X. RE-REGISTRATION OF PROGRAMS MIGRATING EITHER FROM NTR TO WIR ‘OR OLD WIR TO UPDATED WIR 1. Within a period of one (1) year upon the effectivity of the appropriate promulgated TR and upon due notification from TESDA, an NTR program shall be submitted for re-evaluation and re-registration as WIR in accordance with the prescribed requirements of the TR. (Refer 10 TESDA Circular No. 17, Series of 2000). A program which is not re-registered within the prescribed period shall be subject fo closure proceedings. 2. Within a period of one (1) year upon the effectivity of an updated TR and upon due notification from TESDA, a WIR program shall be submitted for re-evaluation and re-registration in accordance with the updated IR. A program which is not re- registered within the prescribed period shall be subject to closure proceedings, XI, COMPLIANCE AUDIT 1. Conduct of compliance audit by TESDA or a TESDA recognized third party auditing body shall be undertaken one (1) yeor after the program regisiration. Thereafter, compliance audit shall be done once every two (2) years. 2. TVls whose programs were found not complying with minimum standards shall be required to address deficiencies within they (30) calendar days upon receipt of nofice. Failure on their part fo comply within the prescribed period shall subject the program to closure proceedings. xl I. MONITORING AND EVALUATION OF REGISTERED PROGRAMS |. All registered programs, whether WTR or NTR, shall be regularly monitored by TESDA. Likewise, they shall be evaluated based on certification rates and employment rates of graduates to determine the quality and effectiveness of program delivery. Terminal Report Form 138 oF within Thidy (G0) calendar days f Student Aller the end of every Program rent_Record XIll, REFERRAL AND TRACKING OF GRADUATES 1. A qualified Corer Guidance Officer shall be designated by the TVI. Employment of graduates being a IVET metrics of performance shall be monitored or reported to TESDA POs/DOs within six (6) months to one (1) year after graduation. 2. The TVis shall submit to TESDA POs/DOs the employment monitoring report every six (6) months to one (1) year after graduation. XIV. PUBLIC ADVOCACY/PROGRAM ADVERTISEMENT OF REGISTERED PROGRAMS. 1. The TESDA Central Office shall publish the compendium of IVET registered programs annually for public guidance and information. 2. The Regional Officess shall likewise publish the list of TESDA registered programs in their respective areas in newspaper of local circulation. 3. The TESDA Central and Regional Offices shall regularly update their database of registered programs and upload them in the TESDA Website (www.tesda.gov.ph). 4, The TVis shall put up @ signage containing the following information in a strategic area in front of the institution's building: > the title and duration of the program > the status of registered program whether WIR or NIR with TESDA registration number; and > date the CoPR was issued. 6. Any TVI that advertises or announces a program before a CoPR is granted shall be subject to sanctions. XV. SANCTIONS AND PENALTIES ‘A. GROUNDS FOR IMPOSING SANCTIONS AND PENALTIES 1. The following shall be grounds for imposing sanctions against a TVi under TESDA Circular No. 31 s. 2003, “Guidelines on Penalties and Sanctions under UTPRAS": Unauthorized offering of an unregistered TVET program: b. Advertisement of an unregistered program; c. Discovery of any fraud or deceit in connection with the application for program registration. 2. The sanctions to be imposed shall be over and above the criminal liability that the head or owner(s) may incur in accordance with Section 68, Chapter 1. Title V of the Education Act of 1982 which provides “that any person upon conviction of an Act in violation of the authorization requirements shall be punished with a fine of not less than two thousand pesos {P2,000.00) nor more than ten thousand pesos (P10,000.00) or imprisonment for a maximum. period of 2 years, or both at the discretion of the court.” “if. comporation commits the act, the school head, together with the person oF persons responsible for the offense shall be equally able,” Sanctions against the school shall be without prejudice to the right of, the aggrieved students, teachers and employees to go after the erring officials and TV's B, GROUNDS FOR CLOSURE OF PROGRAMS AND REVOCATION OF CERTIFICATE OF PROGRAM REGISTRATION OF A REGISTERED PROGRAM The CoPR of a program of a TVI shall be revoked after due process if the circumstances so warrant, for any of the following causes, without prejudice to instituting appropriate actions and the impositions of appropriate sanctions agains! the responsible institution officials: 1. Failure of the TVI to continuously comply within a specified fime frame with the TESDA standards as determined in a compliance audit conducted by TESDA or a TESDA-authorized third party auditor: 2. Failure of the TVI to revegister its program from NIR to WIR or from WIR to updated WTR within the prescribed period: 3. When the employment ‘ates of the graduates of an NIR program are lower than the national average for three (3) consecutive batches; i 4, Mismanagement or gross inefficiency of the school personnel in the operation of the schoo! and its program offering: and 5. Fraud, falsification, mistepresentation, or any similar acts of the ™. XVI. PROCEDURES IN THE CLOSURE OF PROGRAMS. The following procedures shall be followed in effecting the closure of a registered program: 1 The TESDA POs/DOs shall issue a written communication calling the attention of the TVI for the probable cause of closing of the program. Within five (5) working days from receipt of the written notice, | the TVI must explain in writing for not closing the program. if the TV| fails to respond within the prescribed period, it is incumbent upon the concemed POs/DOs to take measures fo recall the CCoPR of the TVI within five (5) working days atter the lapse of the S.working days reglementary period fo respond. The TESDA POs/DOs shall act within five (5) working days on the explanation letter. If the TESDA POs/DOs find merit on the ‘explanation given by the institution, the Office shall send a letter to the institution giving it fifteen (15) working days to correct its deficiencies and/or violations. Upon final review that the program has been decided for closure, TESDA shall effect the cancellation of the CoPR._ The TESDA POs/DOs shall send its recommendation to the TESDA Regional Office that shall prepare the Notice of Program Closure. to the ins The TESDA Regional Office shall act on the recommendation of, the TESDA POs/DOs within five (5} working days. Upon receipt of the Notice of Program Closure, the TESDA POs/DOs shall send the Notice to the institution. If shall require the institution to surrender the CoPR within five (5} working days. The TESDA POs/DOs shall send a copy of the Notice of the Program Closure fo the Office of the Mayor for their information. The POs/DOs shall coordinate with appropriate body to effect the closure or may request the Office the Mayor, as the need arises, for aid in the execution of the closure proceedings. The insfitution or program that is ordered fo be closed is required {o facilitate the transfer of credentials of the students within thirty (30) calendar days to the other institutions offering the same program and the submission of past/graduated students’ records to the TESDA POs/D0s The TESDA Regional Office shall send a report to the TVET Systems Development Office {TSD0) of the Central Office regarding the Closure of the program for deletion in the database of registered programs, XVI VOLUNTARY CLOSURE OF REGISTERED PROGRAMS Closure of @ TVET program while the program is on-going shall not be allowed by the Authority, unless for a valid reason or force majeure. ATVI that intends to voluntarily close its program(s) shall comply with the following requirements and procedures: 1. The TVI shall formally inform in writing the TESDA POs/DOs of its intention fo close the program and the reasons for such decision three (3) months before the actual program closure. 2. The TVi shall likewise inform its students of the decision to close the program at least three months before the actual program closure. 3. The TVI shall bear the expenses and facilitate the transfer of the students and their credentials to other institutions offering the same program. 4, The TVI shall transfer to the TESDA POs/DOs all the credentials ‘and records of their graduates one week before the actual closure of the program. Failure of the IVI to comply with the above voluntary closure procedure shall be subject to appropriate charges. XXII, REPEALING CLAUSE Al prior issuances inconsistent with any of the above provisions are hereby rescinded or amended with respect to the contrary stipuiations contained in the prior issuances, XXIV. EFFECTIVITY These Guidelines shall take effect fifteen (15) days after the publication in a newspaper of general circulation.
