THE CONSERVATORY AT MILL CREEK

FLOORING REPLACEMENT RULES AND REGULATIONS

The Conservatory at Mill Creek Bylaw 3(h) - Duties of an Owner - reads as follows: An Owner
will not replace the floor covering of a Unit with hardwood flooring or ceramic tile, without first
obtaining the consent of the Corporation.
As this Bylaw does not adequately address the overall flooring replacement issue, the Board has
chosen to continue to follow the position taken by the Property Developer with the original
Owners in the building. This position, as it relates to all present and future Owners, is reflected
in the following rules and regulations:
1. If your Unit is on the parkade level, or is on the first level and is not above a parkade level
Unit, then flooring choices are discretionary. For clarification purposes, this would exclude
Units 113, 114, 115 and 116 which are located above parkade level Units.
2. For Units positioned above other Units (i.e., the four first floor Units identified above and all
other Units on the second, third and fourth floors), living-room, dining-room, hallway and
bedroom area floors are to be carpeted and must continue to remain so. Flooring for front
door entrances, kitchens, bathrooms and utility rooms are discretionary.
3. All proposed flooring replacements are to be submitted to the Board of the Condominium
Corporation for compliance review.
4. Installation of non-compliant flooring will result in an immediate removal order at the
Owners expense.
