Order Granting Motion to Consolidate

Before the Court is Plaintiff, Viewpointe Archive Services, LLC’s (“Viewpointe”)

Unopposed Motion to Consolidate its Declaratory Judgment Action with 2:06-CV-72-DF-CMC.

The Court grants Plaintiff’s Unopposed Motion to Consolidate and orders that Viewpointe

Archive Services, LLC v. DataTreasury Corp., Case No. 2:05-CV-459-DF be consolidated with

DataTreasury Corp. v. Wells Fargo & Co., et al., Case No. 2:06-CV-72-DF-CMC, and that the

Court’s Status Conference scheduled for April 4, 2007, in Viewpointe Archive Services, LLC v.

DataTreasury Corp., Case No. 2:05-CV-459-DF, be vacated and removed from the Court’s

docket. The Court finding that Viewpointe’s motion is well-taken, it is hereby

ORDERED that Viewpointe Archive Services, LLC v. DataTreasury Corp., Case No.

2:05-CV-459-DF be consolidated with DataTreasury Corp. v. Wells Fargo & Co., et al., Case

No. 2:06-CV-72-DF-CMC.
