Defendant Blockbuster, Inc. ( Blockbuster ) hereby provides notice that this is a related

case, pursuant to Local District Court Rule 40.1(G).

Blockbuster explains as follows:

1. On April 30, 2007 ChoiceStream, Inc. ( ChoiceStream ) filed an action in this

Court seeking declaratory judgment that certain patents owned by Plaintiff Lycos, Inc. ( Lycos )

are not infringed and invalid. That case, Civil Action No. 1:07cv10824 - MLW, is now pending

before Chief Judge Wolf.

4. This action and the action before Chief Judge Wolf concern the same patents,

common questions of fact and law, the same or similar claims and defenses and overlapping

parties. Accordingly they are related actions as defined in LR 40.1(G).
