CONDITIONAL OFFER OF APPOINTMENT OBLIGATIONS:
‘On June 20, 2012, Ray Tensing agreed to accept a conditional appointment offer for the
position of “Reserve” police officer with the Colerain Police Department. He also acknowledged
his understanding and acceptance that final approval and retention of the position was
contingent on the following conditions: From the “appointment conditions, the following
require action:
1) The undersigned prospective officer was required make a payment of $1,000 to the Police
Department as a means to offset the cost assoclated with the purchase of equipment. The
reserve officer must pay at least $500 within the first six months of the appointment and
the remainder prior to the officer's one year anniversary.
2) The undersigned prospective officer will agree to an 18 month payback schedule forthe
remaining $2,000 assoclated with the cost of equipment, The payback schedule will requlre
the reserve officer pay the department $111.11 for each month remaining in the first 18
months of his/her appointment, should he or she separate.
3) Should the undersigned prospective employee voluntarily separate from the Department
within one year of the offer date, the prospective amployee agrees to reimburse the
Colerain Police Department $1,000 for the expenses associated with the hiring process for
‘the prospective employee.
Ray Tensing accepted the Conditional Appointment Offer, Including the above outlined
conditions, on June 20, 2012. See attached “Conditional Offer of Employment.”
Condition One: Ray Tensing returned equipment to include equipment that he was eligible to
ratain, to include: duty belt (outer and inner belt) and accessories, rain jacket, reflectorized
vest, flashlight and uniform brass,
Condition Two: Ray Tensing agreed to an 18 month payback for the additional equipment and
uniforms required for the position of police officer for Colerain Township. Based upon the June
20, 2012 acceptance date of the “Conditional Offer of Appointment, Ray Tensing|s credited
three months of service time, equivalent to $333.33 In the payback formula. Ray Tensing is alsocredited for the cost of one police officer “bulletproof” vest, which he provided at no cost to
‘the Colerain Police Department. The credit is equal to the cost paid by the Department for one
new officer “bulletproof” vest. The Colerain Police Department cost is $532.00. Ray Tensing Is
also credited the cost to purchase one pair of handcuffs. The credit amount is $45.00
Based on the service time credit of $333.33, and the credit of $577 for the vest and handcuffs,
‘the total credit for “Condition Two” of the appointment agreement Is $910.33,
Condition Three: Ray Tensing agreed on June 20, 2012 that should he employee voluntarily
separate from the Department within one year of the offer date, he would reimburse the
Colerain Pollce Department $1,000 for the expenses associated with the “intrusive”
examinations used by the Department, after Ray accepted the offer. Specifically, the intrusive
examinations are the medical and psychological evaluations.
Ray Tensing provided a psychological evaluation report from Dr. James Daum for his police
officer position with the Village of Greenhills OH. This evaluation resulted in a savings of $575
for the Colerain Police Department. Therefore, a credit in the amount of $575 Is applied to Ray
Tensing’s separation payback amount.
‘TOTAL REIMBURSEMENT AMOUNT:
| agree to reimburse the Colerain Police Department the agreed upon amount of $800.00. The
repayment of the agreed upon expenses is due, in full, November 1, 2012.

Please let this letter serve as a request to revise the “Conditional Appointment Offer’ as
a reserve police officer with Colerain Township. I would like to discuss the terms of the
contract and some misunderstandings I had associated with the contract.
I would like for both of us.to mutually agreeito rescih” and revise the contract. Iam

expectations.

I provided a level 3 bullet-proof, ballistic vest ($675.00) and my own handcuffs and belt
keepers. Also, the COTP did not have to purchase any winter-duty gear. At no cost to
COTP was a complete psychological evaluation used from my current employer.
‘The expenses incurred by COTP for my short appointment are:
Complete medical evaluation (Urgent Care) $343.00
(2) uniform pants $100.00 to $150.00 (approx)
‘Timberland duty boots $150.00 (approx.)
Man hours for background/polygraph/home interview, etc.
Due to the short period of time I was appointed, and with most of the issued equipment
returned (in mint condition and can be re-issued), I propose to pay COTP $800.00 to
cover all the costs associated with my appointment. In addition, I provided the citizens
of Colerain Township (60) sixty hours ($1,370.00 approx. value) of free law-
enforcement protection in the few weeks I held my appointment.
The contract terms are misleading. 1 understood the payback schedule was to be
$111.11 per month for each successive month I was appointed. It is unfair to expect
me to work for free (60 hours), return most of the equipment and owe additional
money in the amount of $1,850.00. Item #3 (Is misleading) on page one regarding
appointment obligations states, ..."Should the undersigned prospective employee voluntarily
separate from the Department within one year of the offer date, the prospective employee
agrees to relmburse the Colerain Police Department $4,000 for the expenses associated with
the hiring process for the prospective employee.”
Please take into consideration that I am currently employed part-time with no benefits
and I am paying my parents for college expenses (graduation March, 2012). I do not
have the financial resources for the above amount and nor do I agree with the above
amount. I believe that $800.00 is a fair and reasonable offer.

CONDITIONAL “APPOINTMENT” OFFER
‘The undersigned individual agrees to accept this conditional appointment offer for the position of “Reserve”
Police officer with the Colerain Police Department and understands that final approval and retention of the
Position is contingent on the following conditions:

examination, including drug screen,

Officer “Collective Bargaining Unit” and may be removed from the position for any reason or for no reason,

officer.

Condition One: Ray Tensing owes the Colerain Police Department $1,000 for equipment
purchased and provided by the Colerain Police Department. As agreed upon, Ray Tensing
retained equipment and uniform related equipment, valued at $1,000.00.
Condition One, Option One: Ray Tensing chooses to return the duty belt (outer and inner belt)
and accessories, rain jacket, reflectorized vest, flashlight and uniform brass. Because the
separation was early in the appointment, the Police Department is open to the return of thelisted property. The $1,000 fee would be reduced $664.00. The adjusted
would be $336.00

and reimburses the Department $1,000.00,
Condition Two: Ray Tensing agreed to an 18 month payback for the additional equipment and

20, 2012 acceptance date of the “Conditional Offer of Appointment,” Ray Tensing is credited
