Defects in a notice of loss or


preliminary notice of loss

Rule: All defects in a notice of loss or
in a preliminary notice of loss that
the insurer omits or fails to raise
from the notice of loss are a deemed
waived.

Raises no duty on the part of the
insured to supply defects

2. Failure to take objection promptly
and specifically upon that ground

Policy requires by way of preliminary
proof of loss the certificate or
testimony of a third person

Effect of refusal of failure to procure:
Insured must furnish reasonable
evidence to the insurer that refusal
was not induced by any just grounds
of disbelief in the truth of the facts
