9 Cause of the Accusation

The real nature and cause of the accusation against the accused
is the actual recital of facts stated in the information or complain
(Nombrefia v. People, GR No. 157919)
Failure to make the required allegations is fatal to a charge of
arson. (Buebos v. People, GR No. 163938)

Sec 10. Place of the Commission of the Offense

essential elements occurred at some place within the jurisdiction


of the court.
Particular place is an essential element - the description of the
place of commission must be specific.

Sec. 11. Date of the Commission of the Offense


General Rule: It is not necessary to state the precise date the offense
was committed
Except: When it is a material
Sec 12. Name of the Offended Party

name and surname , appellation or nickname must be stated


fictitious name
true name must be inserted if disclosed or ascertained.
It is sufficient to state its name or any name or designation by
which it is known or identified

- Sayson v. People - the designation of the name of the offended party


is not absolutely indispensable for as long as the criminal act charged
in the complain or information can be properly identified.
