SEBASTIAN, SAN VICENTE, ILOCOS SUR
ORDER
Based on records, the following are the established facts:
Acting on reports of illegal blacksand mining at locos Sur, this office dispatched
4 team of technical personnel on January 22, 2013 to conduct an ocular inspection Brgy.
San Sebastian, San Vicente, Hocos Sur.
During the ocular inspection, no activity was observed. However, a two-line
processing plant equipped with rotary screens and magnetic separators, as well as earth-
moving equipment such as two (2) units dump trucks, two (2) units front-end loader and
two (2) units backhoe, were present in the area, The disturbed area is approximately one
(1) hectare covering the present excavation site, magnetite sand concentrate stockpile,
and processing plant and is within the 200-meter zone closed to imining activities
According to Vice Mayor Jose C. Tabanda IIl_who was present during the ocular
inspection, the operation is being undertaken by Wellresource Mining, Tno, and that such,
‘Qperation is not covered by any permit which is the very reason why he reported the
matterto this Office
With the result of the ocular inspection, a Cease and Desist Order dated January
28, 2013was issued to Wellresource Mining Inc. Subsequent thereto, a follow up Cease
and Desist Order dated March 26, 2013 was issued.
Wellresource, Inc., thru Mr. Willy Sy, submitted its reply to the second Cease and
Desist Order in a letter dated April 3, 2013. In said letter, Mr. Sy stated, among others,
that Wellresource has no operation at Brgy. San Sebastian, San Vicente, Ilocos Sur. By
such disclaimer, said corporation has effectively relinquished any claim over the
magnetite sand found in the area.
Furthermore, no other person or entity expressed any claim or interest over the
said magnetite sand.
IN VIEW THEREOF, and pursuant to Section 124 of Administrative Order No.
2010-21, the subject magnetite sand is hereby CONFISCATED in favour of the
government and shall be disposed of in accordance with law.

‘After a series of verifications and investigations, it has been established that your
company has been processing magnetite sand from Brgy. Caparacadan, Caoayan, Ilocos
Sur without the corresponding mineral processing permit issued by' the Mines and
Geosciences Bureau. Moreover, the extraction thereof was undertaken within the 200-
meter zone of the shoreline which is closed to mining operations, The stockpiles of
magnetite sand in the said area is proof of said activities.
In addition thereto, your company was reported to have transported huge volumes
of magnetite sand from Brgy. Caparacadan, Caoayan, Ilocos Sur to the Port of
Salomague, Cabugao, Ilocos Sur for the purpose of exporting the same to China without
the necessary Ore Transport Permit and Mineral Ore Export Permit issued by this Office.
According to the documents submitted to the Philippine Ports Authority, your company is
the shipper of said magnetite sand.
In this regard, you are given a non-extendible period of TEN (10) DAYS from
receipt hereof within which to submit a written explanation under oath why the
magnetite sand stockpiled at Brgy. Caparacadan, Caoyan, Hlocos Sur as well as those
found at Salomague Port, Cabugao, Ilocos Sur should not be confiscated in favor of the
government.
