VEENA RANI, LD CMM, SAKET COURT, ND CC NO. 4 . : IN THE MATTER OF: Star India Pvt.Ltd V/s Home Cable Network & Ors - 7 STATUS REPORT Hon'ble Madam, It is submitted that the said complaint was received in DIU/SED and marked to me, After that the counsel of complainant has also filed some documents which were needed for investigation The alleged person namely Mr. Vikki Choudhry was also directed to join the enquiry. He accordingly Joined the enquiry and during the course of enquiry, he has also provided some documents and intemet copy of the documents/ orders have been obtained as well Till now from the enquiry conducted so far, the following facts has come on record. u 1. The alleged runs his business of Cable TV Services in the ame of Hagnt Cable feiwork from the registered office of the said company ie 19, CSC-[DDA] Sukhdev Vihar, New Delhi — 25, .” and been a regular licensee of the complainant company for almost 20 years for redistributing the Star TV channels signals to its customers. 2. In the year 2013 in the month of December the alleged person has requested that he may be allowed to provide its Cable and internet services also in the NCR. region of Delhi, for which the alleged company is already holding licences issued from the concerned Ministry of I&B and Department of Telecom from the Complainant company i.e Star India which was that time part of Media Pro enterprise. The complainant company then refused the request of the alleged company about the said request and had issued a disconnection notice to the alleged company for the signals provided. On the said notice the alleged company had filed a petition in TDSAT ( Telecom Dispute Settlement and appellant Tribunal ). The TDSAT had stayed the disconnection notice issued by the Complainant company vide its order dated 20/12/2013 (Internet Copy Attached ) a! 4, Ithas also come on record that the Director of the alleged company, has sent an email to owner of the parent company 2st Century Fox on 11/02/2015 through his counsel in USA, regarding complaint against the senior most officials of the complainant company. The*said mail wast acknowledged by the parent company on 24/02/2015 . In the reply to the complaintimade by the alleged person the said parent company has threatened the alleged person which is evident from the email as " If your client has evidence, produce it, Otherwise, I suggest that your client devotes his attention to responding to the piracy and contempt charges in India". (Copies of mails provided by the alleged are attached) After this‘incident only various’eomplaints were filed in TDSAT and other agencies by Complainant Company " Star India [P] Limited’ 5. On 1/05/2015 a penalty of Rs.25 lacs was imposed (Intemet Copy Attached ) upon the alleged company consequent upon which the alleged company has filed an appeal against the snid order in the Hon'ble Tigh Court of Delhi whieh is still pen © . ‘ eects ‘ “tt is also pertinent to mention here that after the said order dated 1/05/15 the alleged company claims to have stopped transmission of all Star TV channels as the stay dated 20/12.13 was recalled in this order and signals were stopped by the Complainant company. 7. The claim of the Complainant that the alleged company was re-transmitting the Star TV Channels on 26/03/15 and 26/05/15 is not reliable and seems to be motivated. Itis also further mentioned here that the license of the alleged company was valid before pronouncement of the order dated 1/05/15. as mentioned in Para 5. The credibility/ authenticity of the CDs prepared by the complainant is dubious in itself as it is not supported by any customer who ig @ regular the customer of the alleged company. The contplainant. has also failed to provide the copy of itemised Cable TV bills of the customer as well as any statement of the customer of the alleged company to corroborate the version of the complainant company. AAs per the document filed by the alleged person/company, it reveats that the complainant has not, furnished the entire facts and has deliberately concealed material facts in the present complaint as the complainant when asked that whether any matter is pending between the parties but the duly authorized representative of the company has ¢efused that no matter is pending between the parties . On perusal of the documents, itis clearly revealed that the alleged company and the complainant Company i.e Star India Pvt. Lid. are already into litigation with each othe] and the dispute of disconnection of channels is already sub-judice in the TDSAT and High Court of Delhi, (Internet Copy Attached). As regard to the alleged CDs furnished by the complaint, the same cannot be authenticated merely on viewing/playing it and for which the source, other requirements have to be compiled with as per the provisions of law. The present complaint seems is an act of malice on the part of the complainant against the alleged company and its director or employees as a counter blast to the various complaints/representations sent by the alleged company through its director. As per enquiry conducted so far, no case is made out on the basis of the present complaint. However the directions of the Hon'ble Court will be complied with.
