How does the Constitution guard against tyranny?

The gathering of all powers in the same hands, whether of one, a few or many, is the
very definition of tyranny James Madison. After a long war against King George, the
colonist gained their independence. Then fifty five delegates met in Philadelphia in the
year pf 1787, to create our constitution. Our government guards against tyranny in
many ways. Tyranny is the absolute power in the hands of one individual or multiple
people. The constitution guards against tyranny in three ways which are separation of
power, checks and balances, and federalism.
Separation of power is the first guard. Separation of power is the separation between
the three branches of government, which are legislative, executive, and judicial.
Separation of power guards tyranny because each branch is in different person hands.
Therefore no one has total control over the whole government. Legislative branch is
controlled by congress, only congress can make laws. The executive branch is
controlled by the president he is responsible for enforcing the laws and passing them to
the judicial branch. The judicial branch is responsible for determining if the law is
constitutional or not (Doc. B)
The second guard against tyranny is checks and balances, which means each branch
can limit the powers of each other. Checks and balances protects against tyranny
because each branch checks each other to keep them balanced. Congress approves
the presidents budget. The president can veto or decline the congress acts. The judicial
branch can claim congresss laws unconstitutional. Judicial branch can also claim
presidents acts unconstitutional. While the president can nominates judges. But
congress can impeach the president and the judges from office. (Doc. C)
The third guard against tyranny is Federalism. Federalism is the division between the
state government and federal government. The power is divide so the federal
government wont have too much power over the state. The federal government gets
the powers that was written in the constitution. Federal government does things like
make money, declare war, and provide army and navy. Anything that is not listed in the
constitution is giving to the state government to handle. State government gives out
drivers license, marriage license, establish schools. And there is also shared power that
they both do such as borrow money, set up courts, and enforce laws. (Doc. A)
The constitution guards against tyranny in three ways. Separation of power guards
against tyranny because each branch is controlled by someone else. With checks and
balances each branch limits what the others can do. Federalism is the division between
the governments. The power I divide so the federal government doesnt have all the
power over the states. With our great constitution still working there wont be any
tyranny going on this way!
