SECTION1.SHORTTITLE

ThisactmaybecitedastheInspectImportedFoodActof2015.

SECTION2.FINDINGS

Congressherebyfindsanddeclaresthat,
1)Theaveragecostofphysicallyinspectingorsamplingalineoffoodthatisimportedorofferedforimportintothe
UnitedStatesisapproximately160dollarsperfieldexamandapproximately3,100dollarspersampleanalyzed.
2)TheFoodandDrugAdministrationisresponsibleforthesafetyofanestimated80percentoftheUnitedStates
foodsupply.
3)TheFoodandDrugAdministrationonlyreceivesabout40percentofthefederalgovernmentdollarstofood
safety.
4)TheFoodSafetyModernizationActgivestheFoodandDrugAdministrationthepowertoinspectfoodand
facilitiesmoreofteniftheyarethoughttobeatahigherriskofcontamination.
5)AccordingtotheFoodandDrugAdministration,aboutfifteenpercentoftheUnitedStatesfoodsupplyis
importedfromover200differentcountries.
6)

TheFoodandDrugAdministrationphysicallyexaminesbetweenonetotwopercentofallimportedfoodinthe
UnitedStates.
7)

Betweentheyears1972and2007,FoodandDrugAdministrationinspectionsofAmericasfoodsupplydeclined
81percentduetofundingshortfalls.
8)

About50percentofthefruitandtwentypercentofthevegetablesthatAmericansconsumecomefromother
countries.
9)TheFoodSafetyModernizationActallowstheFoodandDrugAdministrationtoprohibitafacilitytodistribute
foodiftheagencydeterminesthatthefoodproducedatthefacilityposesaprobabilityofserioushealth
consequencesordeath.
10)AccordingtoCentersofDiseaseControlandPrevention,anestimatedoneinsix(48million)Americansget
sickfromfoodborneillnesseseachyear,resultinginroughly128,000hospitalizationsand3,000deaths.

SECTION3.STATUTORYLANGUAGE
A)TheInspectImportedFoodActof2015shallherebyprovide30milliondollarsperyeartotheFoodandDrug
Administrationtoinspect100percentofimportedfoodenteringtheUnitedStatesports.Thousandsofnewworkers
shallbehiredandtrainedbyattendingamandatoryclass,onlyiftheyhavenothadformaltrainingoreducation
priortobeinghired.Aftercompletingtraining,eachindividualworkershallbestationedataUnitedStatesport
closesttotheindividualsresidence.Theseaforementionednewworkersshallexamineeachimportedfoodproduct
thatenterstheUnitedStatesports.Ifafoodproductisdeemedworthy,theproductshallentertheUnitedStates
foodsupply.Forafoodproducttobequalifiedasworthy,theproductmustnotcontainanytypeofdisease,
bacteria,orberottenandmustbeessentiallysafetoeat.Ifafoodproductisdeemedtoodangeroustoenterthe
UnitedStatesfoodsupply,theportthatthedangerousproductwasimportedtoshallalerttheFederal
Governmentoftheincidentandprovidethelocationofwheretheproductwasinitiallyimportedfrom.Forafood
producttobequalifiedastoodangerous,theproductmustcontainanytypeofdisease,bacteria,orberottenand
mustbeessentiallyhazardousandunsafetoeat.
B)TheFoodandDrugAdministration(FDA)andCenterofDiseaseControl(CDC),ifneeded,shallbothbe
enforcementagencies.TheseagenciesshallbefundedbytheFederalGovernmentbytakingapproximately30
milliondollarsfromtheUnitedStatesmilitarybudgetperyear.
C)

TheInspectImportedFoodActof2015shallbeenactedonJanuary1,2016.Thereisnoexpirationdateforthis
bill.
