PETITION
COMES NOW the petitioner, through the undersigned counsel and unto this Honorable
Court most respectfully avers the following to wit:
1. The petitioner is the biological mother of Mark Daniel Soriaga y Rodriguez, who is
only 16 years of age at the time of filing this petition. Furthermore, said petitioner is
Filipino, single, and a resident of Blk. 32 Lot 6 Molave St. Ph3 St. Joseph Village 10
Brgy. Langgam, San Pedro, Laguna. More importantly, petitioner is acting in her
capacity as a representative of Mark Daniel Soriaga y Rodriguez;
2. Respondent Local Civil Registrar of Manila, holding office at the Manila City Hall,
whose duty among others, is to register and keep records of births of individuals born
in Manila, is impleaded in its official capacity and may be served with Court
processes;
3. Respondent National Statistics Office is also impleaded in its official capacity and
may be served with Court Processes at Solicarel Building Ramon Magsaysay
Boulevard, Sta. Mesa, Manila;

4. On October 16, 1998 Mark Daniel Soriaga y Rodriguez was born at the Our Lady of
Lourdes Hospital, Sta. Mesa, Manila; of parents Angelina Abancia Rodriguez and
Danilo Papa Soriaga;
5. That his birth was received and registered by the Local Civil Registrar of Manila on
October 16, 1998. The said certificate of live birth is herein attached as Annex A;
6. That on his certificate of live birth, it appears that his parents were married on May
31, 1998 in Antipolo, Rizal. The truth of the matter however, is that his parents were
never married on the said date. Neither did they marry before nor after the indicated
date; and that they currently remain unmarried. Furthermore, the Office of Civil
Registrar General issued a certificate whereby they verified that their records do not
contain any record of marriage concerning Angelina Abancia Rodriguez. A copy of
said certification is attached herein as Annex B;
7. That despite being unmarried, the his father, Danilo Soriaga executed an Affidavit of
Acknowledgement and Consent on May 7, 2014, wherein he recognized that
notwithstanding the fact that he and Mark Daniels mother are not married, he
nonetheless acknowledges Mark Daniel as his biological son. He further gave his
consent and allowed the child to use the surname Soriaga. A copy of the affidavit is
herein attached as Annex C.

WHEREFORE, the foregoing considered, it is respectfully prayed that Entry No. 18 in

the Certificate of Live Birth of Mark Daniel Soriaga y Rodriguez concerning the marriage of his
parents be corrected and changed from May 31, 1998 to Not Applicable (N/A).
Other just and equitable reliefs are likewise prayed for.

I, Angelina Abancia Rodriguez, of legal age, Filipino, single, and a resident of Blk 32
Lot 6 Molave St. Ph3 St. Joseph Village 10 Brgy. Langgam, City of San Pedro, Laguna, under
oath depose and state;
1. That I am the petitioner in the above entitled case, acting in a representative capacity
of my child Mark Daniel Rodriguez Soriaga, who is a minor at the time this petition
is filed;
2. That I caused the preparation this instant petition including this certification
verification and have read the allegations contained therein;
3. That the allegations contained therein are based from my own personal knowledge
and from authentic records on hand;
4. That no other petition was filed or presently pending in other jurisdictions;
5. That in case I learned that other similar petition was filed or presently pending in
other jurisdiction, I undertake to inform this court within five (5) days from
knowledge of such fact.
6. That I executed this verification/certification to attest to the truth of the foregoing
facts and to comply with the provisions of Adm. Circular 04-94 of the Honorable
Supreme Court.
