to

be

registered

by

Narasimharaja Police Station, Mysuru for the offence punishable


under Sections 343, 366, 366A, 376 R/W 34 of Indian Penal
Code and Sections 8, 17 and 21 of Protection of Children from
Sexual Offences Act, 2012.

I have gone through 164 statement made on 14th

August 2014 by the victim which disclose that she left the house
voluntarily

and

went

to

Mysore

and

thereafter

came

to

Bangalore; she stayed in the house of the petitioner and there


he committed the alleged offence many a times.

Later she

called her mother on 2nd August 2014 and her parents came to
Bangalore and took her to native place.

Earlier also this

petitioner had approached this Court when the investigation was


not complete. Now, since the investigation is complete and the
charge sheet is filed, the petitioner is not required for custodial
interrogation.

Hence, I am inclined to grant bail to the

petitioner. Accordingly, the petition under Section 439 of Cr.P.C.

is allowed and the petitioner is granted bail subject to the


following conditions:
1) Petitioner shall execute a bond for a sum of
Rs.25,000/- with one surety for the like sum to the
satisfaction of the jurisdictional court;
2) Petitioner shall not hold out threat to prosecution
witnesses or tamper with evidence;
3) Petitioner shall attend the court on all dates of
hearing;
4) If

the

petitioner

violates

any

of

the

above

conditions, prosecution will be at liberty to seek


cancellation of bail.
