"Rosahameap oh Ketooetanit” FROM THE DESK OF THE POMHAM February 4”, 2016 Marilyn Shannon MeConaghy ‘Acting Director/Head of Legal Services Office of the Director State of Rhode Island Department of Revenue One Capitol Hill, 1* Floor Providence, RI 02908 AFFIDAVIT & PUBLIC NOTICE NOTICE OF TAX EXEMPTION Wigwosan Ms McConaghy, ‘This OFFICIAL AFFIDAVIT AND PUBLIC NOTICE from Neesu Wushuwunoag, Pomham Sachem and Tribal Trust Manager of the Mashapaug Nahaganset Tribe, isto serve as public and official notice that the Mashapaug Nahaganset Tribal Trust, and all of its property and legal extensions, is to be considered exempt from taxation by the STATE OF RHODE ISLAND, and any of its egal extensions. ttis the Mashapaug Nahaganset Tribe's position that the STATE OF RHODE ISLAND, and all of its legal extensions, has no jurisdiction to impose any form of taxation upon the Mashapaug Nahaganset Tribal Trust and/or any ofits property and/or legal extensions, and any actions taken by the STATE OF RHODE ISLAND, and/or any of its legal extensions, in this regard are considered illegal and unlawful. ‘TITLE 44> CHAPTER 30> PART 1>61 (d) of the State of Rhode Island General Laws states that "A trust or other unincorporated organization, which by reason of its purposes or activities is exempt from federal income tax, shall >be exempt from the Rhode island personal income tax, except with respect to its unrelated business taxable income.” Further tribal protections are also afforded under both the Jay Treaty of 1784, an international treaty lending to protections for the “Right of Passage” for American Aborigine under the Foreign Sovereign immunities Act; and also under the International Organization Immunities Act, where on December 9" 1945 the United States Congress relinquished every public office ofthe United States of America tothe United Nations, including the state public offices of the STATE OF RHODE ISLAND, To provide clarity on this matter, the Mashapaug Nahaganset Tribal Trust formally requests to be provided with official copies of any and all provisions of law demonstrating the authority and/or jurisdiction ofthe STATE OF RHODE ISLAND, and/or any of its legal extensions, to regulate taxes on 1) a legally and lawfully created Trust Institution in the State of Rhode Island or 2) against American Aborigine’s rights of movement, travel and access to roads and highways, that is superior to the rights and authorities specified in the State of Rhode Island General Laws, the Jay Treaty of 1794and/or the International Organization Immunities Act. Further, if the STATE OF RHODE ISLAND is unable to provide these documents, the Mashapaug Nahaganset Tribal ‘Trust formally requests that 1) the STATE OF RHODE ISLAND, and all of its legal extensions, consider al property of the Mashapaug Nahaganset Tribal Trust to be “intangible personal property” ofthe Mashapaug Nahaganset Tribal ‘Trust, as defined by TITLE 44 >CHAPTER 3 >§ 2.1 of the State of Rhode Island General Laws, which states “Notwithstanding any other provisions of the general laws to the contrary, no city or town sholl assess ony tax on Intangible personal property.”; 2) an immediate refund of all axes that have ever been illegally coerced out of the Mashapaug Nahaganset Tribal Trust and any of its property or legal extensions; and 3) that offical communication be sent to the STATE OF RHODE ISLAND’s Department of Revenue, Department of Motor Vehicles, Department of Taxation, Department of Municipal Finance, Department of Revenue Analysis, and any and all other Agencies that may require notice from your Agency clarifying that the Mashapaug Nahaganset Tribal Trust, and al ofits property and legal extensions, are to be considered “intangible personal property” at all times and under all circumstances excluded from any and al taxation imposed by the STATE OF RHODE ISLAND, and/or any of its lgal extensions. This request i to be formally carried out by a date of no longer than 30 days from your date of receipt ofthis correspondence, Please note that the Mashapaug Nahaganset Tribal Trust has reviewed the Motor Vehicle Code for the STATE OF RHODE ISLAND, as well as USC Title 18>Part lsChapter 2> § 31. Upon reviewing the “code” the Tribal Trust, understands that all motor vehicles are required to register and receive a proper license to ‘operate’ on the highways. In an effort to promote unity and lawfulness, the Mashapaug Nahaganset Tribal Trust conditionally ‘accepts this premise, and agrees to abide by all of the precepts in the Motor Vehicle Code, so long as they do not Violate or impede the Tribal Trust’s ability to exercise its rights and privileges provided under and expressed in the Jay Treaty of 1794. For informational, process and record keeping purposes, included with this communication please find 1) a copy of the receipt for taxes illegally coerced from the Mashapaug Nahaganset Tribal Trust by the STATE OF RHODE ISLAND'S Department of Motor Vehicles for registration of Tribal Trust property, which isto be fully reimbursed, ‘and 2) a copy of the Public and Constructive Notice that has been filed in the Providence County Register of Deeds detailing the Mashapaug Nahaganset Tribe's official status and standing as an American Aborigine Tribe operating under its own private commercial Tribal Trust. Additionally, a copy of the “Mashapaug Nahaganset Tribe Declaration of Repatriation Nation Member Roll Affidavit {& Public Notice of Tribal Nation Declaration” and “Mashapaug Nahaganset Tribe Declaration of Repatriation Tribal Member Roll’ filed with the Providence County Register of Deeds, has been included with this correspondence, This document provides a listing of all human property belonging to the Mashapaug Nahaganset Tribal Trust, which should at all times be considered “intangible personal property” of the Mashapaug Nahaganset Tribal Trust, and ‘exempt from taxation by the STATE OF RHODE ISLAND and all of its legal extensions. Please note that the Mashapaug Nahaganset Tribal Trust reserves the right to update and add information to this listing of human property at any time in the future. ‘This Affidavit and Notice is being sent via Certified Mail Number 7015 152000001 3617 8090. This Affidavit and Notice left un-rebutted after thirty (30) days from its date of receipt, shall stand as fact inlaw. In closing, thank you in advance for your timely attention to this matter.
