1. Environmental law can be regarded as a Multi-Sectoral law. Discuss


It means that this law touches many sectors like the agricultural sector,
fishing sector, irrigation sector, industrialization sector, transport sector,
infrastructure sector, communication sector, science and technology
sector, land planning and land adjudication sector, mining, tourism,
population, health sector deforestation, human settlement sector,
education sector and the energy sector. The activities and operation of the
foresaid sectors, require constant coordination and evaluation on all
matters relating to the environment. This is done by the National
Environmental Management Authority.
2. Why is environmental Law regarded proactive law?
It provides that every person in Kenya is entitled to a clean and health
environment and has the duty to safeguard and enhance the
environment. The right ti a clean and healthy environment includes access
to public elements of segments of the environment for recreational,
educational, health, spiritual and cultural purposes.

3. Explain the obligations arising out the Occupation Health Safety Law of
2007?
Occupational health and safety involves more than simply correcting
unsafe actions and conditions relating to occupational health and safety
includes the following:
1. The promotion and maintenance of the highest degree of physical,
mental and social well being of workers.
2. The prevention among workers of ill caused by their working
conditions.
3. The protection of workers in their employment from factors adverse
to their health.
4. The placing and maintenance of workers in working employments
that are adapted to their individual physiological conditions.
5. The promotion and maintenance of working environment that is free
of harassment
