Clark The Environmental Protection Agency hereby grants a specific exemption under the provisions of section 18 of the Federal Insecticide, Fungicide and Rodenticide Act, as amended, to the Florida Department of Agriculture and Consumer Services for the use of tolfenpyrad (CAS No. 129558-76-5) to control various thrips (including Thrips palmi, Frankliniella schulizei, and F. occidentalis) on fruiting vegetables crop group 8-10. This specific exemption is subject to the conditions set forth in your request dated November 16, 2015, as well as the following. conditions and restrictions: 1, The Florida Department of Agriculture and Consumer Services (FDACS) is responsible for ensuring that all provisions of this specific exemption are met, FDACS is also responsible for providing information in accordance with 40 CFR 166.32(b) Accordingly, a report summarizing the results of this program must be submitted to EPA headquarters and the EPA region 4 office by June 31, 2018 or prior to requesting another specific exemption for this use. In accordance with 40 CFR 166,32(a) these offices shall also be immediately informed of any adverse effects resulting from the use of this, pesticide in connection with this exemption. Page 2 of 3 2. The product, Torac® Insecticide (EPA Reg. No. 71711-31, containing 15.0% tolfenpyrad) manufactured by Nichino America, Inc. may be applied. All applicable directions for use, restrictions and precautions on the EPA-registered product label including Worker Protection Standards must be followed unless otherwise modified by this authorization 3. Toraci Insecticide may be applied by ground application only at a single application rate of 21.0 fluid ounces per acre (0.21 Ibs. ai/acre). A maximum of 2 application may be made per acre year (1 app per crop cycle with 2 erop cycles per year or 2 apps in one crop cycle per year), resulting, in a maximum application rate of 43 fluid ounces per ‘acre per year (0.42 Ibs. ai/acre/year). 4, A maximum of 51,600 acres of fruiting vegetables may be treated in the state of Florida. 5. A minimum 1-day pre-harvest interval (PHI), a 14-day retreatment interval (RTI) and a 12-hour restricted entry interval (REI) must be observed. 6. The Section 18 label must include the following restriction: “Do not make applications if bees or other non-target species are foraging in the treatment area.” 7. Residues resulting from applications of Torae® Insecticide made in accordance with this exemption are not expected to result in residues of tolfenpyrad, including its metabolites and degradates, in or on fruiting vegetable crop group in excess of 0.70 ppm. The Agency has determined this level is adequate to protect public health. A time-limited tolerance in connection with this action will be established in 40 CFR 180.675(b) to support this emergency use. 8. This specific exemption expires 1 year from date of issuance This is the first year that a request for use of tolfenpyrad on fruiting vegetable to control various thrips has been requested under section 18 of FIFRA. In the event that an exemption for this use is requested next year, EPA is making a preliminary determination that this use is eligible for the re-certification program (40 CFR 166.20(b)(5)) in 2017. However, because there is uncertainty about the ecological database for this pesticide, EPA encourages FDACS and its partners to work to identify suitable altermative measures for thrips management.
