i.

Procedures for Removal of a Student from a Class.


1. Students may be removed from class if they are disrupting the educational
process.
2. There are no approvals needed to remove a student from the classroom.
3. If a student is removed from class they may receive a behavior ticket (K-6) or
a behavior referral is made (7-12) which is either sent home in paper or
electronic form and/or parent phone call is made.
4. Responsibility for and custody of students removed from class.
a. If removed a student may go to the office, guidance, social workers
office or other appropriate area.
b. Students may be escorted, picked up or travel independently to the
designated location.
c. Student may be accompanied if there is concern for their safety or the
safety of others.
d. If removed students should go to the location in a respectful manner,
when removed they should reflect on the behavior that resulted in
them being asked to exit the room.
e. The teacher has control of the student until student reaches the office.

ii.

Procedures for Return of a Student to a Class From Which the Student Was
Removed.
1. Students may return to class as soon it is determined they are no longer a
disruption to the educational process. Students may return during passing
time or by office pass
2. Students will have a conference with a staff member as a result of their
removal.

iii. Procedures for Notification.


1. If the student is removed for a significant amount of time or is given
a consequence
the student and parents will be notified via phone call, email, note or
other forms of
communication.
IV. Disabled Students; Special Provisions.
Students who are currently identified as eligible under the IDEA or Section
504 will be subject to the provisions of this policy, unless the students IEP or
504 plan specifies a necessary modification. The students IEP team will meet
and determine what if any interventions are necessary. The team will also
determine if it is necessary to begin the reevaluation within the 3 year
timeline.
1. Procedures for consideration of whether there is a need for further
assessment.
2. Procedures for consideration of whether there is a need for a review of the
adequacy of the current Individualized Education Program (IEP) of a
disabled student who is removed from class or disciplined.

3. Any procedures determined appropriate for referring students in need of a


student is removed from class more than ten times in a school year, the
district shall notify the parent or guardian of the students tenth removal
from class and make reasonable attempts to convene a meeting with the
students parent or guardian to discuss the problem that is causing the
student to be removed from class. Before initiating an expulsion or
exclusion of a student with a disability, relevant members of the childs
IEP team and the childs parent shall, consistent with federal law, conduct
a manifestation determination and determine whether the childs behavior
was (i) caused by or had a direct and substantial relationship to the childs
disability and (ii) whether the childs conduct was a direct result of a
failure to implement the childs IEP. If the students educational program
is appropriate and the behavior is not a manifestation of the students
disability, the district will proceed with discipline up to and including
expulsion as if the student did not have a disability, unless the students
educational program provides otherwise. If the team determines that the
behavior subject to discipline is a manifestation of the students disability,
the team shall conduct a functional behavioral assessment and implement
a behavioral intervention plan. Where a behavioral intervention plan
previously has been developed, the team will review the behavioral
intervention plan and modify it as necessary to address the behavior.
When a student who has an IEP is excluded or expelled for misbehavior
that is not a manifestation of the students disability, the education
district shall continue to provide special education and related services
during the period of expulsion or exclusion.
i.

Procedures for Detecting and Addressing Chemical Abuse Problems of Students


While on
School Premises.
1. Establishment of a chemical abuse pre-assessment team pursuant to
Minn. Stat. 121A.26;
2. Establishment of a school and community advisory team to address
chemical abuse problems in the district pursuant to Minn. Stat.
121A.27; and
3. Establishment of teacher reporting procedures to the chemical abuse
pre-assessment team pursuant to Minn. Stat. 121A.29.

ii.

Procedures for Immediate and Appropriate Interventions Tied to Violations of


the Code of Student
Conduct.
1. Violations of the code of student conduct are dealt with in an immediate
manner. Students may be suspended, assigned detention, parent
contacted or other appropriate intervention.

iii.

Any Procedures Determined Appropriate for Encouraging Early Involvement of


Parents or Guardians in
Attempts to Improve a Students Behavior.
1. As part of our PBIS program we contact and notify students of behaviors
as they occur. As part of this program we do conduct a conference with

parents upon reaching a certain number of referrals. PBIS training


happens for students annually.
2. We document and record behavior incidents as they occur as part of
our PBIS program.
