Officers Steve Marino, Jason Van Dyke and Mark Arcillas saw@IUNIRBering at the CTA Red Line station and approached him to condugt.a field interview. The officers announced their office and displayed thelr badges, but @BBMaid “Fuck you, you ain't the police. bowed Officer Marino on the mouth and punched Officer Van Dyke on the shoulder and chest. The officers used ‘emergency handouffing, open hand strikes, arm bars, wrist locks and pressure to sensitive areas to tako! ito custody. The lockup keeper's section of the arrest report indicated that ‘no visible injuries, The CB photographs depict no injury. All of the officers submitted Tactical Response Reports etn n assailant and documenting their use of force. Officers Marino and Van Dyke also completed Officer's Battery Reports. Officer Marino sustained redness ‘and swelling to his face and 8 laceration to his wrist. Officer Van Dyke sustained redness and swelling to his chest and arm and a laceration to his hanc refused to make a statement to the watch commander and detectives. (Att. 5, 6, 7, 8,9, 10, 11, 12, 20, 21) ET photographs of Officer Van Dyke depict abrasions on his left wrist and right hand. ET Photographs of Officer Marino depict abrasions on his left arm and right hand (Att, 29-38) In a report, accused Officer Arcilas provided an account of the incident that corroborates the related Department reports, Officer Arcillas denied the allegations against him and the other officers and stated that he observ trike Officer Marino with his elbow and punch Officer Van Dyke on the chest and shoulder. Officer Arcilas ran to assist his partners and used emergency handcuffing to help them place (EP In custody. (Att, 46) in a report, accused Officer Van Dyke provided an account of the incident that corroborates the related Department reports and that of Officer Arcilias. Officer Van Dyke denied the allegations against him. He added that he did not altempt to arrest MD until ecame an assailant and struck the officers. @jga¥ was verbally abusive, refused to follow commands, stiffened, pulled away and attacked the officers in an effort to defeat his arrest. Officar Van Dyke further stated that while the officers used force in order to take EEF into custody; was not struck after he was handcuffed and shackled, (Att. 51) In a report, accused Officer Marino provided an account of the Incident that corroborates the related Department reports and those of Officers Arcillas and Van Dy Officer Marino denied the allegations against him and stated that no officer struck’ ‘once he was handcuffed. (Att. 56) INDEPENDENT POLICE REVIEW AUTHORITY Pages Log # 1008636 Conclusion: The Investigation revealed that the incident did not occur as alléged. GEFiled this complaint more than a year after the Incident and related at that time that he could not recall if he sustained any injury. When he provided his statement to OPS, however, he complained of injuries that are not supported by the photographs taken immediately after the incident or his medical records. Additionally, .d many opportunities to make a complaint while he was at the police station, but he refused to speak to the watch commander and the Investigating detectives, There Is also no indication that complained of police misconduct when he was treated at Cermak Health Services.
