community, you can see that in some cases, the beauty of our community has
really suffered as a result. You can also see, however, that most Blackhawk
homeowners have found a way to "work around" the drought by planting waterwise plants and./or continuing to water at a reduced rate, thereby maintaining

To help in this process we suggest you talk with your landscaper and
local nurseries that are also available to assist you. We have provided you the
contact information of two local nurseries which can also be found on the
"Landscape Tips" link on our website. In this same section of our website you
will find a link to a list of "Low Water Use Climate Appropriate Plant
Material".

We believe that allowing the drought to negatively impact the


landscaping at any Blackhawk home does a disservice to property values
throughout the community and is a violation of our CC&Rs. Many of the
CC&R provisions emphasize the need to have and maintain beautiful

In recognition of the drought, the newness of alternative landscaping


varieties, and legal requirements, the Board temporarily deferred enforcement of
the Association's landscaping standards. However, it is now obvious that with
careful planning, maintenance and landscape selection, our standards can be met
and landscaping can thrive in Blackhawk, even with the current drought
restrictions. Therefore, the temporary freeze on enforcement is coming to an
end.

The purpose of this letter is to let our members know that starting June 1. 2016. the Board is
initiating aggressive enforcement of the landscaping standards. Our enforcement techniques for
"landscaping violations" can include the suspension of transponder use, imposition of fines, accessing
lots to perform landscaping and "charging back" the owner, initiation of mediation or arbitration, and
even undertaking litigation to obtain compliance (and to recover legal fees and costs incurred in the
process).

Review Committee (ARC) showing what changes you propose to remedy this. This application must
