in the following areas for the reasons stated below: i

WHEREAS, Section 6, Article | of Batas Pambansa Bilang 881 (otherwise known as
the Omnibus Election Code (01 EC), states that, “if, on account of force majeure, violence,
terrorism, fraud, or other analogous causes, the election in any polling place has not been
held on the date fixed, or has been suspended before the hour fixed by law for the closing
of the voting, or after the voting and during the preparation and the transmission of the
election retums or in the custody or canvass thereof, such election results in a failure to
elect, and in any of such cases the failure or suspension of election would effect the result
of the election, the Commission shall, on the basis of a verified petition by any interested
paily and after due notice and hearing, call for the holding or continuation of the election
not held, suspended or which resulted in a failure (o elect on a date reasonably close to the
dale of the election not held, suspended or which resulted in @ failure to elect but not tater
than thirty days after the cessation of the cause of such postponement or suspension of
the election or failure to elect”
NOW, THEREFORE, the Commission, pursuant to the powers vested in it by the
1887, Philippine Constitution, Omnibus Election Code and other related statutes,
RESOLVED, as it hereby RESOLVES to:
A. In areas where there ware nolmisdolivereditacking OBs:
1. Direct the MBOC to suspend the proclamation of the winning candidates, if the
conduct of the elections would affect the results.
2, Direct the Printing Committee to print the official ballots.
3. Direct the Packing and Shipping Committee fo deliver the official ballots to the
Municipal Treasurer's Office (MO), with notice to the Election Officer (EO).
4 Diteet the EO, immediately upon receipt of the official ballots by the MTO, to notly
all interested parties by posting the notice of the conducl of spacial elactions on
May 14, 2016 (Saturday) in the bulletin boards of his/her office, elly/municipal
hall, and barangay halls of the affected barangays, if any. The concemed
Regional Election Directors (RED) and Provincial. Election Supervisors (PES)
shall supervise and monitor the conduct thereof,

5. After casting of votes, ballots will be manually counted by BEls in areas where
elections were previously conducted and electronically transmitted, prepare
election returns by indicating the electronically transmitted results and adding the
manually counted result
B. In areas where no elections were held due to security concerns:
1. Declare failure of elections.
2, Direct the Printing Committee to reprint the Official Ballots for Barangay
Nagpapacao, Clustered No. 17, Matuguinao, Samar only.
3. Hold in abeyance the proctamation of winning candidates for positions that will be
affected by the non-holding of elections.
4, Conduct the special elections in the affected areas on May 14, 2016 (Ssturcay),
with due notice to all interested parties. The concerned Election Officers (EO)
shall post notice of the conduct of speciel elections in the bulletin boards of their
espective offices, city/municipal halls, and barangay halls of the concemed
barangays. The concerned Regional Election Directors (RED) and Provincial
Eleclion Supervisors (PES) shall supervise and monitor the conduct thereof; and
5. The Armed Forces of the Philippines (AFP) and the Philippine National Police
(PNP) shail intensify efforts to ensure the holding of orderly and peaceful special
elections.
Lel the Field Operations Group, Printing Committee, Packing and Shipping
Committee and Project Management Office implement this Resolution,
