I refer to your request of 2016 in which you seek access to documents under
Australian Privacy Principle 12 of the Privacy Act 1988 (Cth) (the Act) in
particular:
"All documents that relate to or form part of any investigations,
intelligence gathering, surveillance or any other AFP function held by the
AFP in which I, [name], am named."
Privacy Act
Australian Privacy Principle 12 (APP12) requires an APP entity that holds
"personal information" about an individual to give the individual access to that
information on request.
The Privacy Act defines "personal information" as:
"Personal information is information or an opinion, including
i n f o r m a t i o n or an opinion forming part of a database, whether true or
not, and whether recorded in a material form or not, about an individual
whose identity is apparent, o r can reasonably be ascertained, from the
i n f o r m a t i o n o r opinion."
APP 12 also operates alongside and does not replace other informal o r legal
procedures by which an individual can be provided with access to information,
including, for agencies, the Freedom o f Information Act 1982 (FOI Act) that
provides a right of access to information held by agencies.

Received a phone call back from Dr Young. During this conversation, Dr Young was
queried as to whether he would like to participate in a formal interview with the AFP
regarding allegations of the unauthorised disclosure of information to the media in 2014.
Details of the ABC media report on 9 December 2014 were raised in the conversation with
Dr Young and he was questioned as to his involvement in releasing any IHMS medical
records to the media, or seeking to obtain the medical records from current or former IHMS
employees.
Dr Young denied both the allegations and also stated he wasn't sure whether he wanted to
participate in an interview and would be seeking advice on the matter.
