This agreement constitutes a lease and not a sale. Hempfield Production Company will be abbreviated HPC. No
part of the agreement shall be deemed payment towards the purchase of any of the equipment. Title shall remain at
all times with Hempfield School District. The borrower recognizes Hempfield School Districts ownership and
title, and agrees to keep the equipment free from all liens, levies, and encumbrances. By signing this Leasing
Agreement, you agree to the following terms:
1. Only trained, former Hempfield Comm Tech students may borrow equipment or studio facilities. Equipment
will not be lent without a signed agreement, security deposit, or by anyone who previously has damaged or lost
2. All leases will be granted in week-long increments.
3. Equipment will be picked up and dropped of at Franklin Office at the agreed upon appointment time.
a. Appointments can be made between 8am 4pm Monday through Thursday.
b. No appointments will be made Friday through Sunday.
c. A $5 fee will be charged if you are late for an appointment.
d. Equipment will be provided by HPC staff in person. Its the borrowers responsibility to make
sure the correct equipment is provided before leaving.
4. The borrower shall use the equipment in accordance with the manufacturers instructions, and not use the
equipment in any manner which will subject it to abnormal or hazardous conditions, negligence, or misuse.
5. All equipment will be lent in proper working condition with all parts in their proper place. It is the borrowers
responsibility to check the condition of all equipment before leaving Franklin Office. In the event of a malfunction,
the borrower must notify HPC immediately.
6. The borrower shall not make any alterations or improvements to the equipment, and shall not deface, remove, or
cover any nameplate on the equipment.
7. All equipment shall be operated in accordance with applicable Federal, State, and local laws.
8. The borrower shall retain the equipment in their own custody, and may not sublease equipment out to others.
9. HPC shall have the right to inspect the equipment at any time during the rental term. The borrower shall make
any and all arrangements necessary to permit HPC access to the equipment and prove its in their possession.
10. If a breach of this agreement is determined, HPC has the right to take possession of the equipment and security
deposit without legal process, without liability to the borrower, and without prejudice to HPCs right to receive
lease fees due or accrued up to the date of removal of equipment.
11. Indemnity: The borrower agrees to indemnify and hold HPC and Hempfield School District harmless from
and against any and all losses and/or claims, including without limitation reasonable attorneys fees, arising out of
borrowers possession, use, or operation of the equipment during the time between delivery and its return to HPC.
12. The borrower will be assessed an initial diagnostic damage fee of 25 dollars for all equipment that is returned
damaged or in non-working condition prior to the release of the Security Deposit. The borrow is responsible for all
fees incurred in the repair of equipment up to the maximum as provided on this agreement.

13. Security Deposit Prior to taking possession of the equipment, the borrower shall deposit with HPC, in trust, a
cash security deposit of $50.00 as security for the performance by borrower under terms under this agreement, and
for any damages caused by borrower during the term of the agreement. HPC may use part or all of the security
deposit to diagnose and repair any damage to the equipment caused by the borrower. However, borrower is not just
limited to security deposit amount and remains liable for any balance. The security deposit shall not be applied in
lieu of payment of the lease.
14. This Agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania.
Venue in any action involving the equipment, this agreement, shall be in courts having situs in Lancaster County,
Pennsylvania. The prevailing party in any proceeding shall be entitled to an award of reasonable attorneys fees
and litigation costs.
